MOTOR INSURANCE — Insurance claim rejected

I am H L Dehariya resident of a rural village Nainpur Madhyapradesh ,my age is 65 years. I am a small business man. I am running from pillar to post to get the justice at this age. I am a heart patient and survived by a major heart attack. I am writing here with a hope that you could help me to get the justice.

Brief details -

Here is a case where a 65 year old man fighting against the injustice of the insurance company.At the time of soliciting business insurance agents make tall claims and now that a senior citizen has been deprived of his sole source of livelihood, insurance company is raising hyper technical objections.

Vehicle theft--Insurance claim has been repudiated on following baseless reasons-->

The subject claim is being repudiated because.

1.- Documentary evidence of hiring out of vehicle was not produced .
2- No lease/rent note in favor of mr. sanjay nema was produced.

3. Kamlesh the person to whom the vehicle was given for driving was not having effective driving license.
4.You have failed submit any employment record of driver at the time of loss.
5.-There was a clear violation of condition no.5 of policy terms and conditions.

Can you please let me know if a commercial vehicle needs agreement for every assignments?
I had given this JCB machine to Shri Sanjay Nema on an oral agreementof Rs.90,000/- per month in which driver and major repairs were mine and diesel was of Sanjay Nema. Such like agreements are widelyprevalent in the commercial world. There are many such commercial transaction done orally in this field and and MR.Nema never denied that the he took the machine on rent from me.

Also I am a small business man and do I need to provide offer letter and salary slip to driver to prove the employment of my driver?

Kamlesh was not my driver. My driver was Rajendra Choudhary. Kamlesh was supposed to check the vehicle from time to time at the spot becausehis residence was hardly 300 - 400 meters away from the spot where the vehicle is parked. There is no need of any driving license for such as assignment. In any case Kamlesh was not my driver.Do we need to provide the driving licence of the helper who is not driving at all?

Regarding Point 5 has submitted that no one can keep his vehicle more secure than insured had done on the date of the accident. this allegation is totally bogus.

I need help on this matter.

hi this is dr sindhur(hyundai I 20 owner).. i m very much disappointed wit ur policy.. ur agent named siddaruju(bangalore branch) not communicated properly..he is waste fellow.. i dont know why kept such people in ur company..he is spoilng the company name.. pls take action on siddaraju..contact ,,
