Hello Friends,
As we all discussed over mail, below is the ajenda for our meeting with builder. I would request you all to please read it and let me know your availability. This could decide the future of our society, so please be there without any excuse.
If any one is or knows a lawyer then please get him, charges can be incurred collectively. We should be ready to file a complaint against the builder.

Ajenda :-

1. Club house Membership (Not mentioned in the agreement)
2. Intrest for late payment (None of the demand letters mention the amount of intrest which is pending over)
3. We should ask for the compensation for delay in possession.

All these dues are supposed to be paid by cash and no reciept will be provided.

Can we prepone this meeting on 26 Jan 2012, if every one has holiday on 26th ? We should also check the availability of the builder.

I agree to meet but before meeting we should chart out strategy.

Yes Shreepad. Even if he may ready to give the reciept, but don't be ready to pay this amount which is never mentioned/discussed before.
Already he is giving late possesion and asking for extra money. This should not tolerate.

Noone should ready to pay these unnecessary demand of builder and no compromise even if delay payment as builder himself giving late possession so no way... pl all should stand on same way... Unity always help for positive result..
I think we should intimate Mr.Tingre about the meeting on 29 Jan 2012 at 11.00am, so that he will be available.

We can propound the meeting on 28th Jan 2012, Saturday instead of Sunday 29th Jan 2012.
For Sunday, We need to check the availability of builder and other contact person.
For Saturday, We can directly walk-in and meet the builder and others as this is working day for those people.

As per my past experience, Sunday is not working day for them.
I am also facing the same issue. This is unfair and unethical way for demaning the money which is not included in aggrement. Don't know why builder is doing this. we have being co-operating with him even though he delayed the possession by almost 1 year. I have being paying rent and EMI simultenaously and was just waiting for possession.
Now at last stage he is demaning the extra money.
Lets finalize the date of meeting.
I think saturday is better than sunday, as sunday is not working day for them.
Sambhu Sing has Wednesday as non working day, so on Sunday he might be available
I am available on both the days.

This is an unfair practice. Before Hon'ble Courts' verdict how can the Builder charge the Service Tax on assessee and on what basis ? We should also ask for the relevant statutory compliances / working details /in which Account service tax collected being deposited/ what about the interest thereon/ what about the refund process, if any etc.

Dear Friends,

1. I agree with the poposal and we must resolve it at the earliest possible. Nothing should be paid with is not there in agreement. Definetly our collective efforts are required at this time. If Mr Tingre asks for interest on late payment, then we should also ask for compensation for the delayed possession.

2. I am away in J&K, so I can not be there on 29th Jan. However my family member will definetly be there on the said date and time.

yes, i would be available on 29th 11 am
I am also facing same problem. I have paid all the amounts on time whenever asked by builder with the expectation the we will get possession on commited time. Verbally it was commited July, Then Oct. finally Dec. In agreement also its written Dec. Still there is no confirmation . Now builder is asking more Rs. 40000 as club membership fee which was not mentioned in agreement. Also demanding VAT & Service charges is unethical while case is pending in court.

Plz let me know final date & time to meet.
