Subhash Patil is a cheater builder
This is to inform everyone that I have booked flat in Bldg no 42, Room No – B 701, at Nehru Nagar Kurla East Mumbai 400024, on 8th October 2008. I have booked the said premises through 1) Pratik Subhash Patil 2) Subhash Patil ( Patil Associates ) having office at 1st floor Above UCO Bank Srirang society , Shrirang Compound Thane . I paid stamp duty and registration charges in 2006 at the same time I paid 51000/- down paymnet and 4 lakhs amount.

I applied for a Home loan in

1) State Bank Of Mysore in 2007 with the refernce of builder. They asked for agreement copy , which the builder never gave to me and always gave some or the other reason like “ he is in Delhi “. It is same bank who has approved & funded his project.

2) GIC 2008 – Got the sanction letter from GIC but builder refused to give the agreement copy

3) HDFC 2008 – After GIC sanction letter was lapsed I applied in HDFC and he quarrled with HDFC executives and refused to give the documents to them.

4) LIC 2009 - Got sanction letter from LIC. However again refused to give the documents to the bank.

Without the documents from builders, bank do not give loan. After making the agreement in July 2008 , in just 2 months he sent us the termination notice and also presurrize for more payment. This means he planned from 2006 not to give the flat to me or after the rate will be increased he will demand more from me.

This is mental harrasement to me and my family from last 4 years by the builder. He is Unnecessarily threating us and saying “he is not afraid of any one , can go to any person or go legaly” .

Now the said builder is trying to sell the said flat to another purchaser though I have already registered the flat. We had legally put a case in 34th court of Metropoltan Magistrate’s Court Vikhroli Mumbai from 25.06.09.

Subhash Patil or Patil Associates are cheaters , Please do not book the flat with them . They have cheated more number of people in the same society.

AFFIDAVIT
I, SHRI. NILESH NIVRUTI PARKHE, age 30 yrs residence at Bldg. No. 54, Tenement No.1734, Nehru Nagar, Kurla (E), Mumbai-24., do hereby state and declare on solemn affirmation as follows:
I say that I had booked a Flat No. B-701 in the proposed reconstruction scheme of building no.42 at Nehru Nagar, Kurla with M/s. Puneet Builders, Thane and entered in to the agreement for sale on 30.12.2006 which is registered with Jt.sub registrar of Assurances, Taluka:Kurla, Mumbai on 25/07/2008 under document registration No. BDR 13/5484/2008.
I say that there was a dispute regarding my irregular & delayed due payment to the developer as I could not avail the Housing loan from various financial Institutions. Due to the non-payment as per the prescribed schedule of the agreement, the Developer has terminated my agreement for sale dtd. 30.12.2006. Hence, due to some misunderstanding, I had filed the criminal case in the court of the Metropolitan Magistrate at Vikroli, Mumbai & as per the orders of Hon. Court, order under U/s. 156 (3) of I.P.C. was passed and order of investigation was given to Nehru Nagar Police station wherein an FIR, bearing No.FIR No.216/09 dtd.10.08.2009 was lodged, against M/s. Puneet Builders, Mr. Pratik Patil & Mr. Subhash Patil.
That I have also filed a civil suit no. 337 of 2010, before the Hon. High Court for declaration and injunction which is pending till date.
I say that I have now resolved the dispute with M/s. Puneet Builders and I have cancelled the agreement for sale of the said flat no. B/701 in Building No. 42 at Nehru Nagar, Kurla (E) Mumbai–24 and I have received an amount of Rs. 10, 11, 000/- towards the refund of the amount paid by me alongwith additional compensation for full & final settlement of the cancellation of the agreement for sale dtd. 30.12.2006. The said cancellation deed is duly registered with the Jt. Sub registrar of Assurances Taluka: Kurla vide Reg. No. BDR/13/9650/2010 dtd. 27/10/2010.
I say that I have no charge or claims against M/s. Puneet Builders, Mr. Pratik Patil & Mr. Subhash Patil.
I hereby agree to withdraw the civil suit no. 337/2010, Criminal Case, complaints lodge in Nehru Nagar Police Station & other complains such as Consumer Forum etc. all
Whatever declared is true & correct.

ATTENTION !! I, SINCERELY APOLOGISE FOR MAKING ALLEGATIONS AGAINST WELL REPUTED, RELIABLE AND TRUSTWORTHY PUNEET BUILDERS & Ar. SUBHASH PATIL ….. NILESH PARKHE.

I, Nilesh Parkhe sincerely apologize for making false allegations against PUNEET BUILDERS & SUBHASH PATIL and labelling them as cheaters in my complaints dtd.5.2.10 & 29.3.10 lodged in www.consumercomplaint.in. Infact they are well reputed, reliable and trustworthy, handling many prestigious projects in and around Thane and Mumbai, and at national level. I have realized the same because they have handed over possession to hundreds of flat purchasers in Nehru Nagar without any dispute.
• I also declare that allegations made by me were due to misunderstanding regarding some doubt for the title of the property and my own frustration for not being able to obtain housing loan from financial institutions due to the reasons of my own.
• The issue now being resolved, I declare that I have no charges or claims against Puneet Builders & Arch. Subhash Patil.
• I, SINCERELY APOLOGISE for the same and express my sincere thanks to PUNEET BUILDERS. I am trying to remove my those complaints from the said website display.

Subhash Patil does not pay arrears as well as complete rent for Building no. 37 in Kurla East. He did not pay rent for almost 6 months this year, he pays lower rent every month and at whatever time he desires. Also, there is no increase in rest since inception. He doesn't even reply to emails sent from our people. WHen we try to connect with him, he is very sick. Please investigate and help us.

The agreement also was signed because building was falling and we had nowhere to go.
The project for which all members are facing harassment is attached in the image. Its been almost 3-4 since building has gone under construction and we can just wait and watch.
