I had booked a 1bhk flat in Phase-IV in Badlapur from M/s Siddhitech Homes Pvt Ltd (through DHFL) in the month of Oct.2011 by paying 20% of total cost of flat and am asked by them that the flat no. will be allotted later. When I received the booking receipt, shocked, the flat was booked in Gopal Land-II in Phase-V (and not Phase-IV) and informed me that the registration process will be completed with Phase-IV in the first week of Dec.2011. But even after lapse of three/four months, builder had not allotted to me flat number. In other case/Phase-IV he used to allot flat no. on spot at the time of booking. When I contacted to the builder in this regard he was unable to give satisfactory reply to me and every time/always, when i contacted, replied that the allotment letter of flat will reach you shortly.
It also appears from the sources that the construction of building (Phase-V), wherein the flat was booked, was not approved and there was no plan of builder to start construction in near future.
After considering the fact mentioned above, I have cancelled my booking and requested them to refund my booking amount. After a month, Builder has refund the amount but after deducting the booking amount Rs.21000/-. It is again brought to the notice that I am not aware that the booking amount was Rs.21000/- neither any way they have intimated. Further attention is invited that they have not allotted any flat no. to me and in the booking receipt only mentioning that the booking is against Gopal Land-II, Kharvai, Badlapur then how can they deduct booking amount, where no booking was confirmed.
Whether Rs.21000/- will be refunded to me from the builder. Please advise in the matter please. (SHASHI) Was this information helpful? |
