[Resolved] Triveni Infrastructure Development Co. Ltd. — REFUND OF MONEY PAID FOR PROVISIONAL REGISTRATION OF A FLAT | |||
Sir, i, Commodore Piyush Jha,NM (Retd) had applied for Provisional Registration of a flat at the basic price of Rs. 1674/- per Sq. ft. on 28 June 2006 in an upcoming Project of Triveni Infrastructure Development Company Ltd. and paid Rs. 3,50,000 vide UTI Bank Ch.no. 18912 dated 26 April 2006. Even after 6 months of payment of the money there was no sign of the project. Para 1(c) of the application provides with a condition that if the company is not in a position to make an offer of allotment for a flat within a period of 12 months from the date of application, then the applicant will be entitled for refund of the advance for Provisional registration along with simple interest @ 10% p.a. from the date of payment of such advance. after many visits to the company i finally met Mr Karotiya, Sr. Mgr. Commercial in Juy 2008 and requested for the Refund of the money. As per the directions of Mr. Karotiya, I sumitted various relevant documents but nothing was hear from the Company. Later I filed a case in the consumer Forum at NOIDA in 2010. the Company did not respond to the court orders and never turned up on the dates called for hearing of the case. Finally on 17/03/2011 the consumer forum Judge told me to apply for the case in Delhi as Triveni Infrastructure Company is based at A-27, 2nd Floor, Mohan Co-operative Industrial Area, Mathura Road,New Delhi. I am now 68 years old and find it difficult to run around from pillar to post Please advise as to how to recover my money from the said Company. I am also victim of Triveni, you must get associated with Triveni Faridabad Allottees Assciation at tfaa.in where we all Triveni customers are united and fighting for construction of the project.

Well, Sir, A recent judgement in a Consumer Case (gist given below) may help you find solution to your problem with the infamous co:
Real estate developer Triveni Infrastructure has been directed by a consumer forum here to refund Rs 6 lakh to one of its customers, who had booked a flat in their township project at Faridabad but did not get possession for more than four years.
Finding the company guilty o[censored]nfair trade practice for giving a flashy advertisement despite being "well aware that the aforesaid project would never be successful", the New Delhi District Consumer Disputes Redressal Forum also awarded Rs 25, 000 as compensation for harassment and Rs 10, 000 as litigation costs
"OP (Triveni Infrastructure Development Co Ltd) knowingly and deliberately extracted money from the complainant's pocket through unfair trade practice by publishing in various news papers, 'Path breaking developments in the city of future, Township at Faridabad', as it was well aware that the aforesaid project would never be successful.
"It is totally, unlawful, injustice, malpractice, unfair trade practice of developer (Triveni), which is a violation of Consumer Protection Act, 1987, " the forum presided by C K Chaturvedi said.
The order of the forum came on the plea of Kalkaji resident Vivek Kumar who had alleged that he had paid Rs six lakhs in two instalments in 2006 and 2007 for booking a flat in the real estate developer's township project at Faridabad, but even after four long years the status of the township was not communicated to him.
He had alleged that his requests for delivering possession of the flat or failing that, to refund his booking amount, were met with threats and added that the firm did not even reply to any of his emails.
As the company chose not to contest the complaint despite serving of notice, it was proceeded against ex-parte.
