Kind Personal Attention to Restore the Confidence of Common People
Appeal for Urgent Action against Arbitrary and Discriminatory Demolition
Sir/Madam,
I beg to appeal to you for urgent actions against the erring DDA officials for destroying our all movable property and personal belongings and abruptly and brutally razing to the ground our shelter without any prior notice or information and in my absence and violated our fundamental rights, human rights, natural justice and all relevant procedures of law, over looking and overtaking all directions, issued by your honour to them. The facts are narrated as here-under:-
1. I am a Post-Doctoral Research Fellow at Jawaharlal Nehru University (JNU) and residing at B- 319, ( B – Block ) Vasant Kunj Enclave, New Delhi, along with my family members i.e wife Dr Sameena Hameed, an Assistant Professor in Jamia Millia Islamia New Delhi, younger brother Md. Taiyab Alam, working in Ministry of Health and Family Welfare, Government of India and his wife Mrs Farhan Yasmin, a teacher in a school of Govt. of NCT of Delhi, younger brother Taimur Alam, our ailing aged mother and two kids.
2. On 17/5/2010 at about 4 pm, as it was reliably learnt that few DDA officials led by Mr. Pramjit, Deputy Director, DDA demolished and razed down my house to ground along with our all movable household items, personal belongings and jewelry ( all appx.of Rs 10 lacs) and important certificates and documents, in not only arbitrarily but also in cruel manner and without any prior notice and information to us. The demolition was done against all rules, norms and natural justice, even not followed the basic requirement of the procedure to take out all movable belongings as said above, enlisting them, before demolition of my house This was also informed to local police at PS Vasant kunj through a written complaint..
3. It is worth to mention here, rather most significant aspect, inviting your serious attention that my house on only 50 sq yds, the smallest in the said area, has been razed to the ground while other multi-storied building of nearby were left either untouched or with cosmetic damage, obviously for reasons best known to one and all that the owners of the building are immensely and heavily both healthy and wealthy.
4. It is further worth to mention here that when the demolition squad arrived we were in Holy Family Hospital in process of getting discharged my brother’s wife named above, who was admitted there, being under treatment for a pregnancy complications. On having been discharged, we took her to my house which, I found, was completely demolished and razed down the ground. Along with all the households article including, cash, costly gold made jewelries and documents. Shri Paramjit Singh was so much prejudicial, for the reasons best known to him, and was so much hasty in demolition of my above house that he did not prefer even to take my domestic house holds articles, jewellaries ,cash, and documents etc. to be enlisted as per legal system and to have been kept under safe custody of any local responsible persons or alternatively in the DDAs office, as is being done generally by the police or any other law enforcing agencies. We have lost every thing and have become homeless, shelter less and deprived of my entire basic household article including kitchen materials. Nothing has been left to prepare food for the family and my children.
5. My younger brother Mr.Taiyab Alam had recently got married and all his new household items are damaged. His wife, who has just been discharged from the hospital, is now in mental trauma after knowing this incident due to inhuman acts of the aforesaid DDA. Officials. The question invites your kind attention is that should building a house (shelter) on our own land been penalized with complete derailment and destruction of our normal lives and abrupt deprivation of our shelter with all its basic household items without affording opportunity to explain or save his property/ belongings.? Is such action not in contravention with basic human rights to which our country is also a signatory the international Charter of Human Rights? Even in our legal system if a person is found guilty he is afforded an opportunity to be heard on the point of sentence i.e punishment. Is it not in violation of our fundament right to life, whose meaning has been extended by various Supreme Court Judgments to include all aspect basic to life including shelter? And to provide this to each and every citizen is the basic and prime responsibility of the government. BUT HERE, YOUR HONOUR MUST HAVE REALISED, WHAT TO TALK OF PROVIDING SHELTER, THE GOVERNMENT MEN THEMSLEVES WHO WERE RESPONSIBLE TO PROVIDE SHELTER TO THE PEOPLE BECAME CRUEL DESTRUCTORS OF THE SHELTER.
6. Complete demolition of my house, while other multi-storied building have been left untouched or with cosmetic damage by the DDA authorities is clearly arbitrary, discriminatory and seems to be deeply rooted criminal conspiracy with an object to ruin our lives by demolition and raising down to earth my house along with household articles sparing not a single spoon for use. It has seriously affected our basic human rights as well as fundamental rights as guaranteed under the constitution of India and a slap on the face of country democracy which stands for equality and social justice.
7. It remains absolutely un-understandable as to why only poor persons are victimized in every sphere of his life. I am from a farmer family and have knitted my life through rigorous and hard work in achieving the highest education i.e Ph. D in Geography and when we were able to enjoy the fruit of education, in no moment of time the DDA authorities have shattered our lives completely without notice or information. Is it not open and deliberate violation of principles of natural justice? We have literally become penniless and homeless.
8. It is worth noting that houses and buildings are not built overnight. It has been these officials who were party to such constructions. They have not been able to save forest and ridge lands from land mafia although complaint to the same has been made since years by the residents of the said area. Then one day they come and demolish common man’s house built on his own land without ensuring that he has been adequately and sufficiently informed and time given to him to take out his belongings. How can a common man be solely and brutally penalized with the deprivation of his shelter when these officials are not held accountable.
9. The demolition of our house built on our land is the demolition of a common people’s confidence in Government’s word and practice. It is in the government records, evident from Central Government notification/published in the Gazette in 2007 that the matter for regularizing all so called unauthorized colonies has been under active consideration and from the information published in the DDA magazine, it is clear that a decision has already been taken by the DDA authorities to de-notify the Vasant Kunj Enclave area also among others, and as per minutes of the meeting with the Lieutenant Governor NCT, Delhi held on 8th February 2010, the DDA authorities have been directed to hand over the responsibilities of those area to MCD for their development etc, from the date when a decision has been taken by the DDA to de-notify. Even with such directive from the head of the NCT Delhi, the DDA officials did not care to spare common people’s house. In such circumstances the demolition of a common man’s house when regularization and de-notification process is on, is a question mark on the Government’s words and practice where by people’s confidence is been lost.
10. To avoid recurrence of such cruel an illegal acts of the DDA, necessary legal stern action need to be taken to restore confidence of the common man of a democratic country.
11. We are highly educated as said above, myself being Doctorate in Geography and my wife is Doctorate in Economics and is Asst professor and are always law abiding citizens and still believe in fairness of higher executives of the law and watchdog of human rights agencies of this land. We are not against the enforcement of law against illegal construction but we protest against its arbitrary and discriminatory. We also pray that we have constructed our shelter with our hard earned money after due confidence and cognizance in government process of regularization and have been disproportionately penalized with complete destruction and derailment of our lives. Arbitrary, Discriminatory and Cruel manner in which our small house sheltering eight people has thoroughly shaken our confidence and cause deep mental anguish.
12. It would be appropriate if your Excellency as the guardian of law and head of State to pay a visit or a team of impartial independent officers be sent to the area and witness the mockery the DDA official have made in the name of law through their arbitrary and discriminatory action and how a common man house is reduced to dust admits towering multi-storied buildings.
We are in great pain by both the financial loss, fallen on zero level with indebted life as well as mental agony facing continuously due to the above narrated acts of demolition of my house by the DDA. I don’t know how much time it will take to recover from this man made destruction but hope your timely action against the DDA officials will restore our faith in law of the land and surely will help stop the developing a sense of alienation towards Government agencies.
I request you kindly give your personal visit to see the brutal killing of the Indian democracy and the Constitution. I want justice to compensate our movable property, personal belongings so that we could restart our normal life. or alternatively financial help for our rehabilitation for building up a shelter may kindly be sanctioned and be paid to us to enable us to pass our lives and maintain livelihood, so that we may continue serving the people, through our profession without any mental setbacks.
An early action, as per my above mentioned request, shall yield and restore the confidence of common people.
