eBay India — Goods received damaged and intended denial of claim

I have purchased a sealed cover pack of foreign coins from e-bay and made the payment online. The goods were received in broken condition. A claim was lodged which has been opened as eBay Guarantee* claim - 858885. On the request of company snap shots of the broken product, packaging and envelope was also attached with email. However the company instead of refunding my money and taking the product back is indulging in anti-consumer and monopolistic acts and omissions. After having delivered broken goods, and acknowledging its fault (all evidences are in my possession) the company is harassing me whereas the Seller is merry making. The unscrupulous Seller is being protected, who has already made an illegal gain. The Seller despite knowing that the item was brittle has only wrapped it up in a newspaper. It has charged Rs. 90/- towards shipping but has spent only Rs. 39/- which is very much apparent on the envelope, and thus pocketed Rs. 51/- thereby wrongfully enriching himself by Rs. 51/-. No action ostensibly has been initiated against it. On the contrary I have been coerced to spend more money for dispatch of the item back and then be at the mercy of the seller and e-bay. This would amount to jeopardizing good money after the bad money: I have already burnt my fingers and my money is in soup. E-bay is coercing me to spend more good money after the bad money by spending on return postage which will entail expenditure on postage and time and money in travelling to the post office. I have asked you to pick up the item from my address to which they are not agreeing. To add insult to the injury, they have stated in their mail that the shipping charges would be refunded to me by e-bay coupon. That means that only way of realizing that money would be to further purchase goods from e-bay and possible pay more money to them. Thus I will suffer harassment and e-bay would further make profit out of it. This is clearly restrictive and unfair trade practice whereby ebay would make profit at the expense of the consumers. If I do not comply with their illegal dictates, e-bay has threatened closure of the claim. It is illegal, arbitrary and anti-consumer. Hence I am writing this complaint. I want that e-bay should refund my payment with compensation for harassment; take action against the seller and the damaged goods be collected from my address by e-bay itself. Companies with such policies are a serious threat to consumer movement in India. I am writing this so that the public may be on guard against such tactics.

e-bay has done what had been apprehended--it has unjustifiably and arbitrarily closed the claim. THUS IT HAS PROTECTED THE UNSCRUPULOUS SELLER WHO HAS MADE UNFAIR PROFIT BY SAVING RS. 51/- FROM THE SHIPPING COST--PACKED THE GOODS ONLY IN A THIN NEWSPAPER WHICH CAUSED THE GOODS TO BE BROKEN IN TRANSIT. E-BAY WILL NOW FULL ITS POCKETS AND ENJOY THE COMMISSION AT THE COST AND EXPENSE OF THE CONSUMER WHO HAS BEEN SADDLED WITH WORTHLESS GOODS.
