Intex Technologies — replacement of Battery

Dear Sir Myself Prakash Harne I had purchased a brand new android phone from Intex..i.e.Intex extrme on dt 18.02.2015. But now I am facing problem regarding Battery.. My battery got swollen.. Now I need replacement. As my is not six months old.I can claim for the replacement of battery..but here At Chandrapur Maharashtra the dealer of Intex not allowing me to replace battery instead he ask me to purchase new one..this is violation of contract consumer and company.. This ll surely destroy the image of a brand.. What should I do now ? Should I go to consumer court?
