Larsen & Toubro Infotech [L&t] — gratuity denial

Hi,
My service with l&t was 5 years, 10 months, 13 days (Including probation period)

As per gratuity payment act 1972 (Find below) i am eligible for gratuity as per section 2a

When i check in system and ssc customer helpline both are saying its should be 5 years (Without probabtion period) and i don't agree with it

So my understating is this issue needs to be escalated to the authority in trustee who knows the law and legal.
