Magic holidays-panoramic group: false commitments, fraud and cheating: cancellation of membership (Fm/ cdg/ 0158) and refund of down payment.

In continuation our previous emails dated 03/06/2017, 07/06/2017, 22/06/2017 and dated 24/06/2017 sent to customer. [protected]@magicholidays. Info and conversation with mr. Vishal, some senior functionary in customer relation department of the magic holidays at mumbai on dated 21/06/2017 at telephone no.[protected] and on dated 29-06-17, 05-07-17 and on dated 10-07-17 at telephone no.[protected] regarding cancellation of membership and refund of down payment.
I have got a telephone call from one of magic holidays executive (Radhika -[protected]) on 10th may 2017. She invited me along with my wife at ultimate hyundai show room, industrial area, phase-1, chandigarh to collect a free holiday voucher for two night and three days. She told me that we have to attend a 30-45 minutes presentation. We reached there in time at about 6.00 p. M. Mr. Sonam ([protected]) and mr. Sandeep ([protected]) attended us and they gave us presentation regarding magic holidays. We spent there more than two hours.
They convinced us, by giving several attracting offers and false commitment, for membership of magic holidays. They also assure that we can cancel our membership and take refund if we are not satisfied with the membership even after paying initial money and even after first trip. We were in hurry as already more than two hours spent. Mr sonam take down payment rs.19, 350/- immediately by swiping card and got signed of my wife on some printed papers in hurry. They even did not give free holidays voucher which they promise before invitation. The spa free coupon worth rs.3200 was given expiree dated, i. E. Valid till 30th april 2017.
As earlier stated magic holidaye sales representative mr. Sonam got signed of my wife some printed papers in hurry. Now we came to know that these papers also included ach papers. When i asked mr sonam to give photo copy of the papers which he got signed, he said that it is not possible to give photo copy immediately as photo machine is not available. He further said that he will sand the copy of signed papers through email by tomorrow but did not sand till date. And magic holidays-panoramic holidays got issued/ created from bank (Sbi) ach mandate with umrn sbin[protected] for rs 5484.00 issued to panoramic holidays l created without our concent. As such it is a clear case of fraud and cheating in collision with sales representative mr. Sonam, mr. Sandeep pandit and magic holidays-panoramic holidays and fir to be lodged.
There are much difference between the commitments/information given by the sales representatives of the company on 10th may and commitments/information given in the welcome kit. I have also explain to mr. Vishal some functionary of the magic holidays who contacted me from mumbai from land line number[protected] on dated[protected] at about 11-55 am. Such as:-
1) tenure of the membership told 5 to 25 years. It means if a member can use 100 night in 5 years and he is entitle to use 20 night in one year where as as per welcome kit maximum 14 nights holidays can be used in one year.
2) annual subscription charges (Asc) told domestic rs.1150 per night and international/ aboard asc @ rs. 1700 or rs. 1750 per night where as in welcome kit international asc is rs. 1950 per night.
3) gifting charges @ rs. 1000 per room not told.
4) as per welcome kit the offer is valid for india and asia properties of rci and for europe, middle east, america canada, latin america and africa properties, member will have to pay rs. 10, 000 plus taxes. Where as in presentation we were not told these extra charges.

We are sorry to say that we are not satisfied with magic holidays false commitments and not interested in membership. We had not availed any free services or trips of any single paisa from magic holidays till date.
Although on telephone conversation mr. Vishal assured us to do the needful very soon and also accepted that they have already learnt about mr. Sonam regarding giving false information. But we are sorry to say that customer relations team of the company even did not acknowledge our above emails and we did not received any official information till date. You are requested to kindly got cancelled our membership and refund the amount already deposited as down payment rs. 19350/- at the earliest possible.

Dear Mr. Vishal Vanga,
This is with reference to your e-mail dated 11th july, 2017 regarding refund of amount deposited by us as Down Payment in favour of Magic Holidays-PANORAMIC HOLIDAYS LTD.
Contents of your above cited e-mail are wrong, false, misleading and contrary to the facts. It is wrong that every thing was explained to me at the time of presentation and further on your welcome call, infect on 13th May itself I telephonically requested your representative/sales executive/ manager at Chandigarh to refund my deposit, since having looked at customers’ reviews regarding your company I was not satisfied and immediately decided to withdraw. I continuously kept requesting on mobile to refund my deposit which was obtained by giving false promises and without explaining the scheme in detail and so much so that the co did not give proper reply to my request. Thereafter on receipt of your e-mail dated 2nd June, 2017 intimating me that my Welcome kit will be sent within 15 working days, I sent reply to that e-mail on 3rd June, 2017 to refund my deposit Since I was not satisfied. It is wrong that I did not ask for refund within 10 days of deposit i. e. within so called lock in Period of 10 days.
I further sent e-mail on 7th June and thereafter on 22nd June, 24th June and 10th July reiterating my earlier request and explaining the reason for withdrawal since there was a lot of difference between commitments/ information given by your representative/ sales executive/ manager at Chandigarh on 10th May, 2017 and commitments/ information given in the welcome kit. It seems that you have not gone through the contents of my e-mails and instead of replying to my e-mails you have sent a general and vague reply denying refund of my deposit. Moreover your company can not force me to pay for a service which I neither availed nor intend to avail. Therefore you are once again requested to refund my deposit at the earliest failing which we shall be constrained to take the matter with the appropriate court of law and your company shall be responsible for all consequences and costs.
