Mr Jayesh Dethe,
This
is total injustice and harassment made by you and your company with us by taking
one side decision without considering and listening our sayings and bluntly
refused to refund our money on the grounds of your terms and conditions as per
signed enrolment form which your executive quickly taken our signature and not
at all given us the time to read the terms and conditions, taken away the signed
form immediately after our signature by your executives’. Also You are suppose to give us the copy of
form when we signed but your executive never given with a cheating intention
that we should not read the detailed terms and conditions of the package so that
subsequently we may cancel the membership immediately. we have not received copy
of our signed form till date for our
reading. Please note that Signed
enrolment form is one side and other side we are asking a refund against
cancellation of membership at the initial stage only and due to dis-satisfaction
of your customer service, false promise of gift item which will be delivered at
home, non-fulfillment of your enrolment offer(marketing offer) on time, false
oral information, difference in oral information at the time of enrolment and
actual package received by us after 22 days ie on 4/12/14. So it is my right to claim a refund amount if
we are not satisfied about your service, when we have not at all availed any
benefit or enjoyed your properties at the inception after becoming a
member. You cannot simply refuse to
refund our money on the ground that we have signed an enrolment form and now
company cannot refund our money as per your terms & conditions. Ultimately
it will be treated as cheating only by retaining our money without any justified
reason. So we will request your company
to please take our refund issue with your higher authorities and reconsider the
issue without any further delay i.e
within 3 days otherwise we will compel to take legal action against your
executives and company which please note. You and your company will be held
responsible, for my financial loss to me as well as mental harassment to me and
my family, for any consequences due to non-refund of our money and for any legal
action taken by us against your executives and your company. Now we are claiming our refund amount only
but if you are not refunding my money within 3 days i.e. before Wednesday
31/12/14, refund amount Rs.22895/- will get increase by adding interest 15%
w.e.f.12/10/2014, mental & physical harassment cost, legal cost incurred by
us in this connection and any other cost which we may be incurred towards
getting refund legally i.e. advocate fee, Xerox expenses etc.. Please note that my wife health is also
affected during last few days due to this refund issue. If we incurred any medical cost for both of
us, this will be added along with refund amount which please note.
As
per my trail my, yesterday myself and my wife, 2nd time had visited to your HO
on 27/12/2014 at 4 pm regarding taking our refund amount of Rs.22895/- due to
cancellation of membership. 2nd time, we experienced very
bad treatment from you and your company which we will never forget
(Unforgettable time badly experienced with your company). You awaited us for
half an hour and there was no polite courtesy seen from your company and that
too from Head Office executives. We never expected such type of bad treatment
from executive seating at HO without making any justification towards their
valued customer. This is shame on your company and you all people, specifically
you as a senior executive. One side you are writing greetings, always with
customer and valued customer but practically, it is not at all seen when we
visited twice to your Head Office. When we repeatedly reminded your reception
counter, even though you and your company never bothered to meet me to discuss
the issue. We know we came to your office without appointment but it does not
mean to neglect the valued customer. The reason is you are unnecessary delaying
our issue with an intention of eating our money only by taking help of terms and
conditions. When I have already written a mail dated 23/12/2014 Tuesday for
discussion and then you are started calling from Friday 26/12/14 late evening at 6 pm that also I picked up by
giving a reply to your executive that please call after 5 minutes as right now I
am busy with my higher authorities. But your executive never called me again.
Then I called back but unfortunately, I heard your regular office timing tape.
It is observed that regularly last 2/3 times your executive called on same time
i.e 6 pm even. by giving miss call so that you can send the mail
dt.27/12/2014 stating that your executive called me but I never pick up the
phone and you have given an appointment on Monday. This is a poor and smart
customer service when I am writing a mail on 23/12/14 and customer wanted to
discuss for getting proper justification to his issue. You must appreciate and
welcome the customer for discussion immediately instead of avoiding the
customer. But on the contrary there is a 4 days delay in replying my mail
saying your authorities are not available. Please remember any company will
prosper and will make growth if there are no grievances against their company
and even though there are grievances/complaints, it should be resolved with the
proper satisfaction of customer only. This will create confidence and goodwill
about company in the minds of customers and it will be automatically spread into
market very fast. We are very sorry to say that whatever your yesterday’s
behavior towards us was very shameful and very bad because when you ultimately
came outside at 4.40 pm(we literally waited 40 minutes), you never apologize or
said sorry to us for waiting us long time (40 minutes). When we asked you,
you started blaming us that we have come without your appointment and your
authorities’ time is more precious than customer time. When, we demanded our
refund amount immediately. You, Mr
Jayesh Dethe, Sr.Executive of Magic Holiday, started showing us the Enrollment
form which is signed by us and as per terms & conditions of the form we will
not get the refund. It is our fault only. We also said whether company has
fulfilled enrolment/marketing offer on time.
But Mr Jayesh was not ready to listen anything. He was showing the signed form again and
again. We also replied that all the
signatures differ with each other on all the copies of forms. I do not remember
whether I have signed all the copies because style of signatures differs with
each other. I also told Mr Jayesh that
we have not received any copy of form and receipt till date. It also proves the
kind of pressure created by the marketing executives When we again and again
demanded refund amount today only. Mr
Jayesh Dethe arrogantly loudly replied us in marathi that "REFUND AMOUNT NAHI
DENAR JHAH” (REFUND
AMOUNT WILL NOT BE GIVEN TO US AT ALL WHEREVER WE WANT TO GO WE CAN GO BECAUSE
WE HAVE SIGNED ENROLMENT FORM). Whether
this is the way one senior executive should talk like this. So we got wild after
listening above sentence and asking the refund immediately. But you threaten us that you will call the
corps. Whether this is the way your HO
executive should talk with valued customer.
This itself proves that Mr Jayesh Dethe, Sr.Executives is having cheating
type, rude, arrogant type nature behavior towards customer and not giving any
justification to the customer. Due to such type of executive behavior, issue
will not be resolved but definitely aggravate the issue more.
Ultimately
it is not our failure but your company’s executive failure to convince the
customer and win the confidence of the customer. Mr Jayesh never investigated the matter
properly and given the decision one side without taking into consideration of
our saying and points. If Mr Jayesh
would have taken a decision to refund our amount at the initial stage only, then
it would have proved genuineness about company and definitely it would have
created confidence of the customer towards company and its executives. We would
have felt that some justice is there with your higher authorities at HO. This is one type of publicity which is very
important from company’s point of view.
Now I am giving this advice free of cost and not like you by eating my
money without giving any benefit on time and ultimately making injustice on us
by retaining our valuable money. I will ask one question to all your executives
(Mr Jayesh, Ms Pradnya, Mr Deep, Mr Deepak, Mr Iqbal), please keep yourself in my
place and what you would have done if your money is taken away by somebody
without any justice and proper reason? Can you bear this cost without any
benefit and enjoyment? The answer is
definitely “NO”. So my request to all
your executives please think and make a justice to me by refunding amount to me.
If company is having such type of cheater
executives, company’s survival is definitely in danger because whatever
marketing or business they are doing by eating customer money with the help of
smart cheating marketing strategy i.e filling up the form by executive and
taking customer signature in quickly manner without giving any chance to read
the form and also they are not giving copy of signed form so that customer
should not read the hidden terms and conditions. Then customer should not cancel
the membership within their look up period of 10 days. It proves that there is
no clarity while selling your product.
All the genuine and customer like us will definitely curse to individual
executive of the company as well as company as whole. Definitely, today God has punished us by
giving financial loss along with mental and physical stress to us but tomorrow
God will definitely punish all the executives along with company more than our
financial loss which will not be recovered at all. This will make the Company to CLOSE and
terminate all the executives seating at home and no executive will get any bread
and butter due to their past bad behavior i.e CHEATER. Please note that all good
and bad destiny give rewards accordingly, you have to suffer in this life
only. Because GOD has recorded all the
things in proper manner and time will come, today company eaten my money and
ruined my tours and enjoyment, tomorrow it will be revenged on all the concerned
executives and the company as a whole by GOD. Remember ultimately GOD is their
to make the Justice to everybody. CUSTOMER SATISFACTION IS ULTIMATE SATISFACTION
WHICH WILL MAKE YOUR PUBLICITY AUTOMATICALLY THAN ANYTHING ELSE i.e
CHEATING/FRAUD. Whenever you sale your product there should be a clarity in your
product, win the customer confidence and trust, disclose all the terms and
conditions, if customer is not satisfied about your product please reimburse the
customer immediately as it happens one single case out of 100, always give
respect to customer because CUSTOMER IS GOD FOR YOU. BECAUSE REMEMBER ON HIS SATISFACTION YOU ARE
RUNNING YOUR BUSINESS AND EARNING YOUR BREAD AND BUTTER WITH PROUD
FEELING.
Your
organization is cheating the customers by not providing complete information
about product even signed copy of agreement is also not provided at the time of
registration. This
is not a FMCG kind of product to return if not liked in 10
days.
You must refund my paid amount Rs 22895 with 15% interest within 3
days. Also please return our all the documents(signed original form, signed ECS
form, cancelled cheque, pan copy, copy of telephone bill etc.) which we had
submitted to you at the time of enrollment.
Please also confirm that you have cancelled the membership in your record
as well as also confirm that company has stopped deduction of monthly charges as
per ECS form completely due to cancellation of membership.
Please
note that now we have made a complaint to R MALL Br. as detailed above on
27/12/14 and informed R MALL Management that very shortly we are going to lodge
a police complaint against all the executives of Magic Holidays against CHEATING
made with us by non-refunding of our money when I have not availed any benefit
from the Company. One more information
we have received that we are the 2nd person who is making such type
of complaint. It means already one
person has lodged the complaint against Magic Holidays, R MALL
Branch.
