R.subash — Recovery of land from sbi karur - purchase under public auction sarfaesi act 2002 | |||
We had purchased the property from State Bank of India, Karur under (Public Auction -SARFAESI Act, 2002) as on 11.12.2013. The sales certificate and other documents clearly state that our land is 3761.75 sq.ft. Now the constructed building handed over by bank to us is 3254 sq.ft only. Balance 507.75 sq.ft. is under possession with SBI, (Bank engineer valuation report also clearly mentioned that the property possession has been taken by State Bank of India, Karur Main Branch) now this area was occupied by others with indirect support of SBI. So bank is liable to me for that 507.75sq.ft. Regarding this matter so many times I contacted the Branch manager and asked for his help but he refused and he says that after sales he cannot give any service from SBI and he told the sale was conducted by “as where is and as what is” basis, so he can’t help me and advice me to forget the remaining area 507.75 sq.ft. Before the time of auction itself I demanded the bank for the copies of plan approval, survey map and also mother documents but the bank concludes before auction they won’t give, once you win the auction we will give the entire document copies but after winning the auction bank says that the Plan approval copy and survey map was missing, this is preplanned plan and they wontedly cheated me and bank says if you don’t pay the balance amount within three days, we will forfeit the advance amount Rs-14, 51, 250/-.so I reported to BANKING OMBUDSMAN and SBI regional office.
