[Resolved]  Tech Mahindra — issue with full and final settlement

Hi Team, My name is Pritam Suryawanshi, I am an ex-employee of Tech Mahindra Business Services (Contact Center) at Mindspace - Malad West. My Emp Id is: 37377 My complaint is about the recovery amount of Rs 18, 697/- that I had to pay with no fault of mine. The details of my complain are mentioned below: 15th October 2013: I was doing early morning shift and after half of my shift i was not keeping well and had to visit my gynecologist - I got to know I was pregnant. My doctor had suggested no stress and no work. I went back to office and informed this to my team leader and OPS manager. I was given leaves as I had around 24 leaves in my leave kitty. After 10 days i was advised for my 1st sonography. 25th October 2013: After my sonography report I visited my doctor. Looking at my reports she advised for complete bed rest. I was given a letter by my doctor suggesting complete bed rest for 2 months. In few days i went to office with all my documents and same were shown to HR and my HOD. As per company policy i was informed i can only be given 1 month leave and post 1 months leave i need to resume However due to my medical condition was not able to resume work. After my paid leaves were consumed, i was informed i will be put on Unpaid leaves. 15th November 2013: I had my 2nd Sonography 5th December 2013: I had to visit my Gynac ..She advised me for a stitch at mouth o[censored]terus (Medical term:Tighting of Ohos). I had to take a decision to go to my parents place in Nasik as after the operation it was again bed rest. 8th Dec 2013 I left for Nasik. All this was communicated at office. 11th December I went through the surgery and 12th December I was given discharge. Doctor had given me medical certificate advising for one month rest. I was in touch with my Ops Manager and HR and kept on giving them updates. I had asked them if they wanted me to courier the documents to them - they said they didn't required it. 2nd January 2014: I received a message on whats app from my Manager saying " There is a bad news..Tech Mahindra has come very heavily on PULs n other leaves" I asked him, what he wanted me to do? He asked me to resign. I agreed and asked him to give me the date to be mentioned in the resignation letter. He said, just mail stating I would like to resign due to personal reasons and not to mention any dates. Due to Internet problem there was a delay for me to send my resignation email, however I managed to send the email on 13th January 2014. 20th Jan 2014 was a bad day for me as I had a miscarriage and lost my baby Dates on Email received from Central Exit Clearance 14th & 15th Jan 2014: Received email on exit formality. 20th Jan: Exit clearance details with PDF attachment with no recovery amount mentioned. 25th Jan i received the same email again. 27th Jan: I replied on agreeing to the clearance. 12th Feb: Full nd Final Settlement has been completed. In this email it was mentioned the outstanding recovery amount of Rs 18, 697/- 15th Feb: I replied asking for bifurcation of the recovery amount. 17th Feb: Received the bifurcation with PDF attachment which said recovery amount of Rs 15, 997/- 18th Feb: Received a letter for recovery amount of 18, 697/- The recovery amount was for dates 6th March 2012, 1st March 2013, 24th May 2013, 20th June 2013, 16th Dec to 31st Dec 2013 & 1st Jan 2014 Total 21 days of Recovery. The dates and amount mentioned made no sense to me. The most shocking dates for me were 16th Dec to 31st Dec (16 days) For December month there was a credit in my account for Rs 3, 312/- I called my line HR for explanation. She said these were dates for which I was rostered .. however I was absent and was still marked as present. It was a shock for me as to how i was rostered when my manager knew i was not in mumbai and had gone through a surgery with one month bed rest 27th Feb I went to Spectrum Towers as I needed my salary slips, releaving letter and wanted to get the settlement clear. I went to Comp n Benefit team and asked them what amount i really need to pay .. they asked to ignore the 18, 697/- amount and then asked me to meet finance team for the payment. When I spoke to finance team I was asked to pay Rs 18, 842/- ...everything was messed up no one was able to give me clear understanding on the amounts and the reasons I had pay. Finance team said the bifurcation sent for Rs 15, 997/- was incorrect due to system issue. It was just not a satisfactory reply and explanation. I would like to understand the reason as to why I was rostered on 16th -31st Dec when the department was aware I was not in mumbai and had a surgery . I was not informed about the rostering ... I was still being marked present though i was not reporting to work and HR involvement is a question mark to me. I don't know who is at fault in this entire situation, however no one was in loss apart from me as I had to pay Rs 18, 697/- I only wish to get my money back for those 16 days (16th - 31st Dec) as it was not my fault. I would request you to look in this matter and get this resolved. I would like to give tech mahindra a chance to rectify the error before i approach other means

Hey Pritam,

Did you get any response from them. Actually i read your case, very unpleasant approach by Tech Mahindra.The thing is, something related to this happened with me also(By the way I am a man) and they just misbehaved like they were giving me salary just for free. I want you to raise this issue (If not solved yet) through Facebook i am with you . And what about PF, did they clear your PF amount?

I sent an email to Hr as suggested in previous response of tickets raised in remember portal for negative full and final settlement.
Got the response from her:
We have received the below response from your ex-RM
We gave him work from option but he was not ready . we discussed with him he was ready for early release so we released him.”

This is completely false statement from RM, i never asked for early release, I was ready to serve 90 days notice period.
It was RM or PM decision, if that is the case they would have told to sent an email for early release, I had discussion with RM he told me, pay the amount as that PM had done such thing to lot of people.
Issue : I was ready to serve 90 days notice period but manager gave me early released and after that I received the negative full and final settlement, I have acceptance letter also.
This is completely fraud.
