The Wadhwa Group — Mumbai Goregaon SENIOR CITIZEN COUPLE LOST Rs 60 LAKHS+ in The Wadhwa Group Redevelopment Project viz. Anmol Fortune

In year 2014, Mrs. Ranjeet Kaur Ari & her husband Mr. Joginder Singh Ari paid Rs. 41 Lakhs towards getting an additional 2BHK flat in their redevelopment project. As of today, Wadhwa builder has neither handed over the flat & nor refunded this money with Interest either!

Over and above that, Wadhwa Group owes the elderly couple Rs. 11 lakhs towards Corpus Fund and a further Rs. 7.65 lakhs of Alternate Accommodation Rent for 17 months. These are only the principal amounts and we are not even venturing to calculate interest costs!

The redeveloped building is named Anmol Fortune and is located in Unnat Nagar No. 1, Goregaon West, Mumbai, Maharashtra.

Along with this major malpractise, there are others as well which are as follows:
1) Non Execution of the Tripartite agreement
Although The project ‘Anmol Fortune’ has been completed in 2019-20 and original bonafide members o[censored]nnat Nagar Akshay CHSL. have taken flat allotment and moved in, but even after all this while Wadhwa Realty as the developer is yet to execute Registered Tripartite Agreement with the respective members.
Meaning, the original bonafide members are staying in the flats without sound Legal Documentation.

(2) Pending Dishoused Compensation and Corpus Amount
Pending Dishoused Compensation and Corpus Amount is to the tune of Rs.18, 65, 000 [Eighteen Lakhs Sixty Five thousand] calculated by Unnat Nagar Akshay CHSL. till December 2019.
But it is supposed to be calculated for additional 6 months because the OC was received by then.
This clause stands breached by Wadhwa Realty.

(3) Non Adherence to the Penalty clause
As per the Supplementary Development Agreement, Penalty Clause was to get applicable post 36 months of commencing the project work + 6 months grace time = 42 months.
The project work started by December 2014, therefore the Penalty Clause should have come into force by May ~ June, 2018 which has been not honored by Wadhwa Realty.
This clause stands breached by Wadhwa Realty.

(4) Barred from desired choice of the floor for Flat allocation
As per the Development Agreement, the original bonafide members o[censored]nnat Nagar Akshay CHSL. were entitled to give desired choice of the floor for flat allocation.
But Mrs. and Mr. Ari have been deceived by the Wadhwa Realty and Unnat Nagar Akshay CHSL. Managing Committee in regards to the same. They had chosen the 24th floor for flat allocation but were given forcible default allocation on the 2nd floor. Same has been applicable in case of other original bonafide members. This clause stands breached by Wadhwa Realty.

(5) Over usage of FSI
FSI as per Supplementary Development Agreement was supposed to be used to the tune of 2.5 and if the developer were to use FSI beyond 2.5, he would have needed to pay Rs. 22, 00, 000 [Twenty Two lakhs] per FSI used to all original bonafide members o[censored]nnat Nagar Akshay CHSL.
As per the revert to the Right To Information Act application received from concerned govt. body, FSI has been substantially overused by Wadhwa Realty and no relevant payments have been made.
This clause stands breached by Wadhwa Realty.

(6) Harassment of senior citizens
Both Mrs. and Mr. Ari as Senior Citizens, have been harassed forced to run from pillar to post for getting their rights but to no avail so far without ever interfering in any of the Project Development work or Society Managing Committee work whatsoever. They have always been in good books with everyone.
Wadhwa Realty is liable to pay for damages towards the same.

(7) Justice delayed is Justice Denied
Wadhwa Realty is liable to pay Interest applicable over and above the pending dues discussed in point no. (2), (3) and (5).
