I wish to complain about children learning plan that i purchased on 9th march 2019 at s-171/116 rangpuri pahari p. O. Mahipalpur new delhi in rs - 44, 444/- (Forty four thousand four hundred forty four only) from toppr technologies pvt ltd

At the time of purchasing this learning plan his executive mr. Manish was assured and committed to me:-
(A) that i will receive an electronic tablet along with some study materials like cds, manuals etc within a week of activation of this plan.
(B) that if someone would face any problem from this plan at any time in the future then he will be cancelled this plan immediately and refund my all money within a week time.
(C) that you have an option to make payment in installment to toppr and if someone would face any problem from this plan at any time in the future then you will stop the further payment and paid payment by you will be refunded within a week time.

I am complaining because, at the time of purchasing this plan i made online payment of rs 9444/- (Rupees - nine thousand four hundred forty four) on dated 09.03.2019 vide payment id - pay_c5legmcbxmmbrz. After received this payment he processed the plan for activation but after one day i received a call from cf and they was said your loan of rs - 35000/- (Thirty five thousand) has been approved and paid to toppr. That was showing cheating with me. After that i called to mr. Manish and inform about the conditions then he said that i am coming and clarify all.

Then he came on the evening of 10th march 2019 at my home and said to me that there is no any problem. You will pay all installments to toppr and as i already told and committed to you that if you and someone would face any problem from this plan at any time in future then it will be cancelled immediately and your all paid money will be refunded within a week time.

After a week i noticed that my child were facing problem in this plan and he is not able to understand anything. And also did not receive any electronic gadget as committed by him. Then on dated 25.03.2019 i contacted to mr manish and inform him about the difficulties faced by my child.
Then he said and assured to me that he take up the matter and resolve it and refund my money immediately.
Then on dated 31.03.2019 mr. Manish was said to me that i send a cancellation mail to toppr and after that he will be complete all the cancellation process and my money will be refunded within a week.
As per direction of mr. Manish, same day i sent an email for cancellation of my plan to toppr.
But after waiting of couples of days i haven’t received any response from toppr as well as mr. Manish. Then i was sent many mail and reminders to toppr and mr. Manish also for refund my hard money.
On dated 25.05.2019 mr. Manish asked me about account details for refund the money. Then i send my account details as well as passbook to mr. Manish through email and whatsapp.
But inspite of that neither topper nor mr. Manish refunded my hard money and did not giving any reply.
Now mr. Manish are not giving any reply of my phone call, message and email and whatsapp.
As per false commitment of mr. Manish it is clear that mr. Manish and toppr were doing fraud and cheating with me and cheated me by rs-44, 444/-.
I again made a call to mr. Manish from another number then he picked that number and again told me for meeting at my home within 2-3 days.

Finally on dated 24.07.2019 all whatsapp correspondence and call recording of mr. Manish, was sent to toppr in which he accepted and committed for refund of my hard money.
In spite of that toppr also didn't reply and not refund my hard money. After that it is clear, they both were cheated to me in the name children education.

Prayer
In view of the submissions contained in the preceding paragraphs, the complainant most respectfully prays to the hon'ble forum to direct the opposite party to:
(A) pay my all amount, rs 44, 444/- along with 24% interest;
(B) pay a sum of rs. 40, 000/- towards the physical strain and mental agony suffered by the complainant and his family members (Compensation); and
(C) clear all cf loan amount.

For which act of kindness, the complainant shall, as is duty bound, ever pray.
