[Resolved]  Vmake Visas — Refund money

My name is shanker dayal suman. I am writing to with the reference of my registration through vmake visas consultancy, 305, sheetla house, building no 73-74, nehru place, new delhi.110019 I would like to revisit the entire matter in brief... I registered my self for the pr status for canada and paid inr 30, 000 cash for the same find attached the receiving receipt. An account manager named karuna was assigned to me for handling my matter like, documents: interviews payments, exams. The account manager called me and took all my document: and slept on the matter. I called after a month, i was informed the account manager is changed. The account manager told me that she did not have a proper handover of my case. After a period of 20 days, i was called by that manager(Payal.) for the submission of few documents necessary for the papers processing. I gave papers and received acknowledgement and the information that my documents were complete. I called after a month of this development to know why there was no information over my application’s processing. I got to know that my account mgr has been changed and new account manager name is narendra, once again, and the incomplete / mishandling of the file was done by the previous 2 managers but this time it will be handled efficiently. Now i am told that my documents were incomplete and previous managers gave me an acknowledgement out of gap of knowledge. Upon the persistent queries i was asked to make a payment to a link... Which will be given to me only if i pay money at nehru place. For which i'll have take a day off manytimes earlier. When i showed my inability to do the payment personally, the rep from the consultancy demanded my credit card details to make a payment to some authority in australia. They would not give me the link for making the payment. My grievance: Its been more than 12 months right from my application date; that i have been given stories and reason for not processing my file or for not giving me any update. I have written many email to the top management in good faith. However if i do not receive any positive response. I called their director mr. Ankit kapoor many times but did not receive any positive response from him as well. I went many times to their office but he never meet gave excuses such as he is out of delhi, or not feeling well etc. I have all the mail trails regarding the same. They cheated me, i don’t want to continue with any of their service and want my money back. I would request you to please look into my case and help me getting my money back. Let me answer your allegations in order it is placed:

1) The account manager called me and took all my document: and slept on the matter. I called after a month, I was informed the account manager is changed. the account manager told me that she did not have a proper handover of my case. After a period of 20 days, I was called by that manager (Payal.) for the submission of few documents necessary for the papers processing. i gave papers and received acknowledgement and the information that my documents were complete. Changing of Case managers is done under following circumstances:
a) When our case managers have left the organization.
b) When they are under emergency or sick leave or they met any accident.
c) The client is not satisfied with the services

Under the above mentioned situations we appoint a new case manager to our clients as for any reason we can’t let our clients suffer and sit without a manager.

2) Upon the persistent queries I was asked to make a payment to a link... which will be given to me only if I pay money at Nehru Place. for which i'll have take a day off manytimes earlier. when I showed my inability to do the payment personally, the rep from the consultancy demanded my credit card details to make a payment to some authority in Australia. they would not give me the link for making the payment.
Vetassess, is a Government authority where documents for skill evaluation are filed and the required payments are provided. Our company on behalf of our clients file their papers with advance level of precision and also make the required payment.

As an immigration company we receive thousands of cases everyday and file all of them at one time to the government authority. At this point we deal with personal data of many clients and providing this link having files of other clients to anyone would be against the term of privacy act and we can’t do the same. We cannot at any cost share our client’s details with other person, which is why we strictly prohibited to provide you with the link of payment and asked you to permit us to file your case instead. But due to your lack o[censored]nderstanding the legal system and protection of privacy act you didn’t forwarded the case and for which your case was never submitted by us.

3) My Grievance: Its been more than 12 months right from my application date; that i have been given stories and reason for not processing my file or for not giving me any update. I have written many email to the top management in good faith. however if I do not receive any positive response. I called their director Mr. Ankit Kapoor many times but did not receive any positive response from him as well. I went many times to their office but he never meet gave excuses such as he is out of delhi, or not feeling well etc. I have all the mail trails regarding the same. The main reason of your case failure was your lack o[censored]nderstanding the legal system and protection of privacy act and not permitting us to do our duty as per demanded. Providing your number and blaming us for your mistake is a case of defamation and under section 499 is an illegal act. Kindly remove this post or else we will take a strict legal action against you.

Mr Shankar Dayal, Our team do have an eye on complaint portal and we take care of the same for genuine cases and not for those whose case failed due to lack of his or her own understanding the legal system and protection of privacy act and not permitting us to do our duty as per demanded. But then it is important to answer people like you as our silence can be sometime understood as our weakness.
In the very above complaint posted, you yourself mentioned that – “when I showed my inability to do the payment personally, the rep from the consultancy demanded my credit card details to make a payment to some authority in Australia.”

Payment to Immigration authority is a very basic and import part of any immigration process. First we requested you to perform the same but when we saw that due to your inability for the same your case may get rejected, we asked for details not stolen them from you. So here in our part we only did this to complete our duty for you, for your benefit.

In our agreement signed by you, it is clearly mentioned, that any fault or delay from the client’s side if causes any rejection then Vmake Visas is not responsible for providing any refund. Still understanding your loss we got ready to refund some of your amount, but then you posted this fake blame story on our company name and still expect us to not claim the removal before paying your refund.

Providing your number and blaming us for your mistake is a case of defamation and under section 499 is an illegal act. Kindly remove this post or else we will take a strict legal action against you.

Dear VMake Visa Team, I see your punctuality. As expected you are replying after 6 MONTHS TIME from my complaint date (this is how you guys work). However I am shocked that you guys have opened your eyes on my complaint and well tried to play smartly and safely.

You gave three reasons for Changing of Case managers :
a) When our case managers have left the organization.
b) When they are under emergency or sick leave or they met any accident.
c) The client is not satisfied with the services

I am wondered, all of these three circumstances are in my case.

Now come to the money matter, you guys asked me to share my credit card credentials for the payment and I refused to do so. Give me reason why did you asked my credential rather than giving me another option for payment. Being legal experts tell me which act is applicable for it.

On the top of it, after 12 months when nothing been happened then I met with Mr. Ankit Kapoor and asked him to return my money back. Then I told by Mr.Director that if I remove this complaint from the website then he will return my Money. I have written proof for the same tell me if you want me to send all those mail trails to you.

Now again you guys are threatening me publically that you will take legal action against me if I don’t remove this thread. Tell me is this professionalism and way of running your business.
Now you tell me when you will return my money.

I called at-least 25 times to you office; first time your case manage had left you organization, second time again your case manage has changed don’t know why, then after your new case manager was being sick for more than 2 months and finally when I was not happy with third case manager (Payal) then you again replace her with Mr.Narendra ‘The most straight forward person of this planet’. After all these [censored]s I met your so called top management team and your director Mr. Ankit Kapoor as well. But nobody was ready to resolve my issue. I wasted my most precious 12 months with you guys. Nobody was there to answer my call or my email. If you want I would have attach the mail trail here.
