M/s Sreekish Gas Agency, Bharat Gas Distributor ( under the jurisdiction of Bharat Petroleum Ltd ) has been illegally levying Customers Rs:35/-for each Refill over and above the rate fixed by Petroleum Ministry. This is not only contrary to the policy of Petroleum Ministry, Govt of India but also violation Consumer Act. Moreover, the Distributor is liable to pay service Tax to the Govt on Extra Delivery Charges obtained from Customers which is unlikely. According to the information received from Ministry of Petroleum through Online RTI application Registered No.MOPNG/R/2015/61544 Dt.[protected]., copy of same is given herewith as E-Mail attachments, Gas Distributors are not authorized to Charge any additional Delivery Charges over and above the rate fixed by the Petroleum Ministry in each state, as the Cost of Refills are inclusive of Delivery Charges Rs 18 per Refill paid to the Distributors by OMCs besides Rs;26.06 towards establishment Charges . This distributor has been printing Rs: 35/- as Extra Delivery Charges at the bottom of Cash Memo issued to the Customers illegally. Copies of two Cash Bills No.76698 dt. 16-09-15 and No.83734 dt. 29-09-15 out of several such bills the Cash Bills issued to the Customers; No.9939 and 69366760 respectively are enclosed as a proof of the fraud being committed by the said Distributor. . According to the said distributor, he was given permission by the District Collector, Kozhikode to levy extra Delivery charges Rs.35/- per Refill from Customers over the rate fixed by BPCL. How ever, no other Distributor in this District received such orders from the District Collector o. Moreover, fixing rate of LPG including Delivery Charges is the prerogative of Petroleum Ministry and Collector has no jurisdiction in this subject. More over, Collector is unlikely to single out this distributor to in impose Extra Delivery Charges from the customers. As this matter has already been intimated to the BPCL but action is yet to be taken by the BPCL. Necessary steps may be may please be taken to save customers from the fleecing by the Distributor by taking penal action against the Distributor please. With regards

Reply :- The information sought pertains to PP Section of the Ministry and hence your application has been transferred to the concerned PIO for responding directly to you. (2) However, it is informed that at present LPG distributor commission is Rs. 44.06 per 14.2 kg LPG cylinder, which includes establishment charges of Rs. 26.06 and delivery charges of Rs. 18.00. Customers who collect directly from distributor premises is not being charged the delivery charges.
