[Resolved]  Padmanchal Greens — Fraud Complaint Regarding Padmanchal Greens (D’Villas) Directors Mr. Tirath Sharma & Mr. Nilesh Pandey of Padmanchal Group

First of all, I would like to tell & request all of the investors, who already invested or going to invest in any of project of Padmanchal group viz. (D’villas, AMULYAM or Devashish Homes - Nainital), kindly make sure you won’t invest in any of their projects. Mr. Tirath Sharma & Nilesh Pandey they are highly unprofessional & fraud persons who are also the so called directors of this Padmanchal Group. Hello friends I am Deepak Gupta, invested in one of padmanchal’s project called D’Villas on Sector 138 Expressay Noida. I booked a villa on 20th October 2012 by giving booking amount of Rs. 10.5 lacs by Dream Catcherz PROPMART (http://dream-catcherz.com/) consultant (Mr. Prashant & Mr. Rajan). Padmanchal group people including Dreamcatherz (Prashant & Rajan), claimed & promised that everything is clear about this project, they showed some papers about the land clearance, but simply denied to provide the photocopy for the same. They also assured that this project is going to launch in coming November 2012 on the occasion of Navratras (Around Diwali Time). After justified from Prashant & Rajan from Dreamcatherz & showing faith in a new builder, I have handed over the cheque of booking amount 10.5 lacs to them for confirming the booking which was cleared after 2 days on 22h of October, 2012. But, unexpectedly, project never get launched (even in October, 2013), we always kept calling Padmanchal & Brokers (Dreamcatherz), but they always keep fooling us saying that clearance is pending, this clearance is pending, they still claimed that they getting it launched in coming March (2013), with an appreciated price & you will be getting huge benefits. But yet again, it’s never launched. Myself including my brother, decided to go their office (was in sector 2 noida that time) for seeking clarification of the future of this project. We met Mr. Ranjeet their BDM there, he assured us that everything is under control & we would launch in April End, even I have a welcome letter from padmanchal including mail from Mr. Ranjeet, stating that we are about the start the project & you do not have to worry about it & we also not demanding any further payment till the project become bankable. But as expected again project never got launched. Then we decided to talk to their CEO Mr. Sabih Siddiquee (CEO), he also assured us that some approvals are pending & we are first keeping our focus on Indrapuram project rather than these D’villas, so this project is either getting launched in May end or June first week (2013) positively. Again, project never got launched. Then we decided to take a look on Master Plan of Noida & came to know that Sector 138 is not mentioned there as residential development it’s only for industrial. We have soon rushed to office of padmanchal to meet one of their directors, but we never got him, even nobody in their office ready to provide us the clear picture & contact numbers of any of their director. By this time, we decided to cancel the booking. After lots of calls & follow-ups to our broker, Dreamcatherz (Prashant & Rajan) they informed us that, they have talked with Mr. Tirath Sharma (one of the director of Padmanchal Group) & he is ready to refund your full amount along with interest on 5th of June 2013. On 5th June we kept calling Mr. Tirath Sharma, but he never picked up the calls. On 6th of June he picked my call & when I asked him about the project & refund, he simply said he will meet me in person & clarify everything. Finally I met him in greater Noida & he assured us that everything is clear on project front & padmanchal is just going to start the project with appreciated price. He also assured that we will not demand any further money till the project became bankable. After discussion with family, we decide to take this chance just on the words of a Director (Mr. Tirath Sharma). But, as a big surprise we got a demand letter from padmanchal saying that you have to pay 20% (around 21 lacs) on immediate basis. When we called to Mr. Sharma, he told us that we need to do the payment to authority & we need money for that, that is why we sending demand letter & you have to pay the money. I simply asked him that as per your & your employee’s commitment we not supposed to get any further demand till the project become bankable. Mr. Sharma has just backed out from his commitment. After discussion again with family members we decided to cancel the booking. We immediately informed the Padmanchal office along with Mr. Sharma & Mr. Nilesh Pandey to cancel our booking & refund the full amount along with interest. Which they have agreed & asked to wait 30 days as a part of their process for full refund. But we havn’t go the chq till August end, even after 60 days of cancellation of booking. After hundered of followups over phone & mails, Mr. Sharma handed over the cheque of our booking amount (without interest) on 2nd of September dated 10th of September. Now, on 10th of September we gave a curtsey call that we are going to deposit the chq where Mr. Sharma asked to hold it for more 2 days & asked us to put it on 12th of September. We deposit the chq on 12th & that chq was bounced on 13th September. We again try to contact Mr. Sharma & Mr. Nilesh Pandey, but none of them responded whole day. Next morning Mr. Sharma responded & asked us to wait for another 2 days & he will call us again to let us know when chq again can be deposited again. Till now on 9th of October, we haven’t received any call & not received the call from either of Director from Padmanchal group for our refund. Friends, now we decide to go legal against this fraud company & their directors & I have all evidences in the form of mails, call records & bounced cheque to sui them. My Lawyer already sent them the legal notice, now we are just waiting them to respond. Again, I would like to request you all that please do not invest in any of their projects (D’villas, AMULYAM or Devashish Homes (in Nainital)). If you invest in their projects you will get your worst nightmares of your life & you lose your money & mental rest. I can share my number if you need to discuss, & please discuss with me before investing. Also if somebody has already invested, please share if you faced some experiences, we can surely together take on this builder to the court so that they just can’t play with other’s people emotions & money. Thanks for spreading and making us aware of these types of fraud the builders are doing with our hard earned money. I think these builders take advantage of our judiciary system and keep doing frauds with middle class people. Please raise your voice against each of them and teach them a lesson.

i am sorry that you had nt so pleasant experience with the padmanchal group.

However, i have had a very pleasant experience with them. I had booked a 2bhk in their nanital project, i could nt arrange for funds after giving the booking amount. However Mr. Nilesh registered d property in my name despite of only 10 % of the payment had been made so that i can apply for the loan.

I am indeed v greatfull to them for the support because any other builder would have forfeited the amount by now.

Shruti1986, as you not mentioned your name, but i am believing this is not the tamed or favoured post, as most of the builder ask to their known or friends just to do the damage control. But, even i believe you, then you might be the one case, but we this is fact that we are still struggling for our payment & there is no sign of refund we see.

We have believed them for 13 months but nothing happened, finally we are just getting nightmares getting money back since 5 months (even after promised by Mr. Sharma to do it within 30 days as per company's policy). I believe you have a great experience with Mr. Pandey but our mostly deal happens with Mr. Tirth Sharma, who not at all a gentleman & doesn't keep his words. I have number of mails, & dates commitment from him, but he never meet it & always gives very fake excuses to avoid you.

Even, I have not found Mr. Pandey either a great person to deal with, i talked to him on 30th of June 2013 (have the call log with me) & he promised to handover the refund by 2nd july or maximum 5th of July, but like Mr. Sharma, he never kept his promise, even whenever we tried to contact him, he always tried to avoid, he said just talk to Mr. sharma since only he is dealing in De-Villas.

Look, we have no intention to write anything wrong against anyone, But we are the suferer and left the only option to raise our voice since none of their directors (Mr. Nilesh Pandey & Mr. Tirth Sharma) called us back about the payment status.

Overall customer & after sales experience was bad for us with Padmanchal group. We kept our faith in a new builder, but it's turned out a very bad investment. 10.5 lacs is a huge amount for a service class & they are just not giving any damn to it.

Dear Shruti,

I agree that they helped you, this could be because they do not want to loose the money which will be coming from you after your home loan approval.

If they have forfeited your amount, they would be loosing the balance amount of the flat from you.

There was a potential gain to the builder behind this help. The builders intention in both the cases is different. In deepaks case he has to return the money and in your case his motive was to earn bigger profit by doing marginal help.

I still request you to be aware of such frauds happening nowdays.

Well said Puneet & fully logical. I guess it's surely our judiciary loop holes which allowed builders to take buyers for granted. How can builders sell their projects even before taking proper approvals from authorities. Big builders still have some fear for their reputation as they have to sell their projects, but small builders take their chances bcz they have nothing to loose & same people starts another company to do the same scams.

Now, since its 5 months we have already waited, we planning to start a Facebook Campaign soon, this is the fastest & very effective way to aware people about this company, i am sure this campaign will completely tarnish the reputation of this company & make people aware why they shouldn't invest in padmanchal.

Also, their website (http://padmanchalgreens.com/ - watchout screenshot) is not working since month & this shows very casual approach towards their brand value & company's reputation, when they can't take care of their brand value (website), then how we can expect their seriousness towards their customers.

Another example of their casual approach towards their brand value, they have changed their website address (domain) from www.padmanchalgreens.com to www.padmanchalgreen.com (refer screenshot).

Also, on their contact us page they still showing www.padmanchalgreens.com. One more example of their unprofessional approach, they are using gmail ID ([protected]@gmail.com) as their official communication instead of corporate email (see screenshot).

I am surprised, how company is ready to spoil their reputation but can't give a good service to the customers.

Great move by Noida, Greater Noida & Yamuna Authorities, though builder shouldn't have liberty to do the fraud but anyways some improvement has been made please read the article:

Latest news is, Padmanchal group has stopped construction of their Bhowali project since long due non-availability of funds...There is no clear cut answer from them when they going to complete their Nanital project, even their AMULYAM project is not cleared. Expressway 138 sector Noida D'Villas project stuck in big legal problem...

They don't have money to refund to their investors (like me), please please, i am just informing new investors who going to invest in Padmanchal just beware, there is no guarantee of their projects.

One thing i am suggesting with my bitter experience with Padmanchal, don't trust on new builders instead invest in ready to move projects, instead invest in other builders, check their previous track records, past deliveries & talk to existing customers before investing...One more tip i would like to share, also don't believe on brokers in this case my broker (Dream Catcherz PROPMART, http://dream-catcherz.com/, consultant Mr. Prashant & Mr. Rajan) didn't helped me to recover my money instead they left their customers alone with this fraud builder, try to deal directly with company.

Soon, I am going to start Facebook/Twitter campaign against Padmanchal Greens, Also, going legal & ready to file the case soon, will keep posting the status on this forum. I am not going to leave them just like that; I request all investors who already invested in Padmanchal in any of their projects just contact me so that we can fight together against this builder...

Hope few more people come forward to help me fighting against this builder so that they just can't play with other investor’s hard earned money.

There is another addition of this gang of crooks (Nilesh Pandey, Tirth Sharma), is Yogesh Tyagi (Mobile number - [protected]). After meeting him first time he looked like the person of his words, but unfortunately he is just another crook. He is just making us fool since 6 months now. After his commitment we have taken the court case back in March itself. He committed us that he will pay us on time, but it was false promise.

Guys don't trust him (if he is dealing with other guys as well), I am again re-opening the case against these fraud trio (Nilesh Pandey, Tirth Sharma & Yogesh Tyagi). Just had word with Lawyer & he is ready to re-open the case, now, i just realized they are not in a mood of giving any money. We have waited 2 years, court case will take another some time, but now i decided to move on with court case as well as consumer court case, i have read in the past that consumer court has helped many people to recover their money with these false builders.

I tried to contact with Nilesh pandey, but as usual he is not picking his cell & this tyagi is just a big CROOK.

Hello All

Everything what Deepak said in his original post about padamanchal greens is totally applicable to me as well. It is over 2 years since i paid them Rs 10 Lakhs and they have not returned even a single penny. Each time they make one or the other execuse . Recently the check they gave me also got bounced. This check was signed by Mr Tirath Sharma one of the MD of this fraud company.

Please do not invest in this company in any of their projects or else you will end up in a situation similar to us.
