Cholamandalam Ms General Insurance Co. Ltd — Regarding the settlement

Dear Sir/Mam,
I’m writing this complain regarding recent major faced at insurance company.
Firstly major issues that we faced is inappropriate and disgusting behaviour of the employees I’ll be explaining your all the details.
Unfortunately on 13 October my vehicle met on an Accident (reg no CG10AY7099) and I raised the insurance claim on 18 October and the policy no is 3408/00089795/000/00. On 23r October I received a notification regarding next payment of premium which was around 23000 Rs after all this we contacted Mr Sanjay Patel ambikapur who is the surveyor at Chola MS and explained all the details that our vehicle’s estimate was around 8.75 lakhs Rs then he sent his employees for the investigation and we helped him with all the required evidence like accidental images, reports and the images of the patients who met in that accident. The patient were my father mother and my cousin sister who are not yet recovered from that incident.
We submitted all the reports that were mentioned by Mr Sanjay Patel.
On 15 November just after a month Mr Sunjay Patel said that vehicle is severely damaged and due to high damage he declared it total loss verbally.
After that for 1 month we haven’t received any reports or updates regarding my claim and I was also busy with my family as they were hospitalised.
On 20 Dec when I contacted Chola ms general insurance of Bilaspur they said that Mr Sanjay Patel has left the company 15 days earlier and has not mentioned any details to them and not even mentioned any details regarding the surveyor that was appointed.
After putting some pressure on them they provided me the contact details of Mr Satish karande who is the employee at chola ms Mumbai.
Mr Satish then said that our vehicle is in total loss and also the surveyor Mr Vikas Khare who has recently joined the company said the car is in total loss and by end of December everything will be sorted. Today is 11 February and there has been no settlement made yet and we are been contacting Mr Vikas and Mr Satish and they are delaying by giving us some stupid reasons like this parts is in query and IDV value of the vehicle is 9.16 lakhs and Mr Satish karande was continuously saying that our car is in total loss and you should
write a settlement letter to us that we are ready for settlement of Rs 9 lakhs.
After asking a lot we haven’t received a single update or report or proof regarding our vehicle is in total loss and which he said it verbally not in written. He said to trust him verbally and we trusted and said ki by end of January everything will be settled and still there is no update .
After that we came to know that we were manipulated by wrong informations and reasons.
Then we went to JD TATA from where we purchased our car they said to put some pressure and make this settlement. It has been 4 months still there is no update regarding settlement. After this we somehow contacted Mr sagar sameer who is the head of Tata motors east zone Raipur he contacted Mr Satish
karande then Mr Satish contacted us and said that our vehicle is getting repaired at 7.25 lakhs which is 80% of idv value and if it’s in total loss then why are the repairing it and after keep on repeating it why they are not informing us that on what basis they are repairing it and if I agreed to repair it what are the chances
that there cannot be any mechanical or technical faults as the damage to the vehicle was severe will the insurance company pay for that expenses this is what said to them and they said we have no roleplay here and our work is to do settlement and it’s up to dealerships who is repairing your vehicle. Than why should i take the risk and they don’t and this is some kind of joke to us. If in future anything happens regarding the accident so what will i do. If it’s in total loss we said give us the IDV value and leave it which we said on 27 January and they mentioned about repairing it on 9 January which will cost around 6 lakhs.
Previously for 4 months why they were saying vehicle is in total loss and now they are pressurising us to repair it

There is many irregularities and irresponsible behaviour towards us they make us trust them by the words they say verbally that it’s in total loss and you will get the IDV value now they are saying that the repair cost is 5.5 lakhs which is the liability of the company by this they should keep the IDV value at 5.5 lakhs and what about the mental harassment we faced for 4 months. And for 4 months we are financially burdened by the expenses of the hospital, travels and medicines and now you guys are saying to repair the vehicle. As a middle class whom should we trust they keep on making things hard for us I’ll definitely recommend all of my friends never purchase chola ms insurance as they are not trust worthy. Due to this mental and emotional harassment and the irresponsible and inappropriate behaviour and value of the vehicle I’ll heading to consumer forum and court as soon as possible and there will be no compromise.
