Hi,
I am living in a co op housing society as a tenant.
My landlord has authorised me to use the club and amenities but the socirty has objected to it through a circular barring tenants to use these facilities like club,swimming pool etc.
I am paying the landlord for the same facilities in rent as was agreed at the time of signing of agreement.
My landlord is paying the specified charges regularily and neither o[censored]s is using the club facilities.
Pls suggest can a socirey bar the tenants from using club and other amenities. Was this information helpful? |
Nominla Member definition. A lincensee, subletee, care taker or ocupant who is eligible to be a nominal member through original member. To undstand the rights of nominal member read below.
Following are from 'New Bye Laws of The Co-op Hsg. Soc 2010.'
The bye law no 26 states " A nominal member shall have no rights such as member"
Bye law no 24 b states " The associate / nominal member may have right to occupy the flat with the consent of the member and permission of the soc., subject to the condition set out by the soc."
From the MCSA 1960 states
" A nominal member or sympathizer member shall not be entitled to any share of in any form whats over in the profits or assets of the soc. as such member. A nominal member shall ordinarily not have any of the privileges and rights of a member but such a member, , or associate member, may, subject to the provision of sub section (8) of section 27, have such privileges and rights and be subject to such liabilities of a member, as may be specified in the bye laws of the society."
sub section (8) of section 27
" No nominal / sympethiser member shall have the rights to vote and no such member shall be eligible to be a member of a committe or for appointment as a representative of the soc. on any other soc."
