[Resolved]  Co-Operative Housing Society — Secretary's resignation

I have resigned as the secretary of my Housing society in Mumbai.
I find no one coming forward to take up the responsibility and be the secretary. There are a few members who have been responsible for causing this trouble to all the residents.Need help on how to deal with this situation.
I can take my resugnation back provided I am able to restructure the committee with a few new replacement in the members

I have also resigns from the Secretary and no one is getting forward for the secretary post. Chairman and other managing comitee is also wishing for the resignation. What we can do?

I have resign from the sercetary post on date 18th Feb 2011. The managing committee requested me to worked for one more month. I have worked for one more month and submitted all office to the Chairman of the society. But he forced me to complete the accounts of the work done on 28th of march, I have completed that also. Then he forced me to sign on the cheques for light bill on 3/04/2011, again he was forcing me for daily work of maint billing etc on april 2011, but I refused for the same. Now Assist Registrar, Palghar has ordered me to complete the balance sheet of year[protected]. What can I do now. No body is ready to accept the seretary post
If 8 members out o 9 members of Managing Committee resigned and alone member is the Secretary. Whether the Managing Committee is dissolved or the Secretary can co-opt other members on the managing committee so that the committee can continue and no fresh elections are called for.

My society got 13 building consist 450 flat and 55 shopes, all the shopes are road face (outside compound wall of society) and one of the shope owner approch committee for NOC for starting liquir shope with written permission of builder, as a committee member, we discuss this with our
legal advisor and issued the NOC as a normal practice. Now few members written a letter to committe asking how we hv issued the NOC without consulting respective building flat owners, All the NOC issued in General body meeting which is approved in AGM.
We hv now issued the NOC to shope owner, on the NOC we hv clearly written that NOC is valid only if the member got the approval fm respective
govt authority to start the wine shope. we took the Indemnity bond also fm shop owner stating that any Nuisance to society members, appropriate action will be taken, we did all this homework prior to issuing the NOC, now members are not happy, what is your suggestion, and we as a society b earer did wrong? based on members interest what action we need to take, sai, vasant complex, kandivali west mumbai
I am staying in borivali west, mumbai . My master bedroom in leaking from the top roof . The leakage may be from the bathroom of above flat or due to external reasons. This type of leakage problem is very common in our society. But committee feels that this problem should be resolved by the 2 flat owners staying one below other . Committee is not ready to act as a mediator and take any responsibility. The flat owner above us is not ready to listen to us. We are having senior citizens at home and to resolve the problem asap for their safety . Please let me the bye-laws related to such internal leakage problem and the link related to that. also let me know who should bear the expenses in such scenario?

Hi,

I've owned a flat in Badlapur [E] in 2006 & the society is registered in 2008, we have 3 wings comprises of 43 flats now it's 3 yrs passed after forming the society, Auditor has also been also nomiated but evey year in AGM meeting we are not getting clear Audit report as to check what is the income/expenditure/closing balance or no transperancy in the documentation. even there is no proper clarity in the Audit report, it is not certified also by the Auditor.

There is major dispute in the society account, same has been informed to Society secretary/treasurer/chairman but no action initiated from any of this Member, so would like to take up this matter to Dy Registrar, Kalyan

Secondly would like to have suggestion on as we have 3 wings & is it possible to have wing wise 3 different Bank account under 1 Registered society so that we have manage internally my Nominating our secretary/treasurer/chairman wing wise.

Pls guide us a proper channel or source to deal with above problem,

I want a sample letter of resignation from the post of Secretary
I stay in a CHS society.I am senior citizen The society consists of 3 wings and shops on the outside. The society has built a washbasin adajecent to our flat whcih is causing a lot of nuisance to us.There is also another washbasin at the other corner of the wing.The flat adajecent to that washbasin is a office.The washbasin next to us is being used throught the day and night.The servants of the building as well as outsiders use the same for their daily abulations.They clean themsleves, cough, sneeze, make dirty noises talk loudly on their mobils and genearlly make the place dirty and unheigenic.I have complained to the secretary about the same.I have told the secretary to stop the usage of this basin, but till date no step has been taken in this regard.Pls advise .
i am living in pune, my flat is on the 5th floor. and here is an maintains problem. we all (50) members are giving society on time. but still the lift is switch off from 11am to 5pm. committee said we had electricity bill double than the regular. i think it is impossible. me and other 3 members have a problem that is our children comes from school at 12pm to 1pm and people goes with children by using steps to the 5th and 6th floor, it is very painful. please advise me and give me some suggestions for the following to proceed.
hi.i am stay in nalasopara, achole rd since last 1 yr.we are suffer from some our co.op socity problem.
1) society not give to us matainace receipt
2) No BMC water facility.
3) society not give to us receipt of society transfer, Noc, orignal letter of passasion letter.

so, that, s why we are some members in this socity decided to register complaint against this co.op.hsg society.

Sir,
I have a shop in a co-op housing building. I am a shop owner and shareholder of the society. To protect my shop from thieves I want to put metal grill in front of shop shutter door. The grill will stand in the same level of the balconies above the shop. I sent them a formal letter but here is no reply. Orally society committee is objecting it and call putting grills is illegal beyond the shop shutter/door, Can someone advise me whether society is correct? today the 25th Sept 2012 at 5.00 pm)that you will not be able to run the business at residence or else u will be charged Rs.5000/-as penalty & after discussion I will eb order to stop my profession.

my society secretary complaint against my landlord that i should leave the house after 3 years in pune. my landlord want me to stay here but now a days secretary keep harassing me and my children.they are keep sending letter to my land lord and me for money . please help me and give advice to me..
I stay on the 2 nd floor of a co-op housing society in south Bombay. I had some furniture repairs, polishing and painting done in my house with the permission from the society office by paying Rs.30, 000/- as a deposit. Before carrying out the work my contractor had shown the condition of my flat which had developed massive cracks on the beams, columns, entire ceiling and falling paint in the entire flat, to a female manager of the building who is also a member of the society staying right under my flat. My contractor after inquiring she said that the chairman of the society stays right above my flat and he had some major renovation done in his flat, causing tremendous damage to my flat below. I did not bother to complaint to any body, nor did i ask for any damages.
While the work was in progress in my flat the manager and the security guard used to barge into my flat every few days to check if any wrong doings was done there in and harass the workers. (Entering my flat without my consent is unlawful).
After the completion of work the manager summoned me with the contractor to her flat accusing us with abusive language for creating some minor cracks on her ceiling, which she claims was due to heavy banging from my flat. My contractor after inspecting replied very politely that it was not possible due to banging because before developing cracks on your ceiling first my floor tiles would break, secondly he said, before executing work in my flat why didn't you show me your unaffected house.Thirdly as she claims that her house was painted just a year ago and no cracks should appear, which me and my contractor feel very absurd. Sooner or later the cracks on the ceiling is bound to appear,
Would someone like to comment on this?
Dear Sir Kindly guide me as I am residing at Ganesh Appartment, Booty More Ranchi as Tenant. After giving the Society Charge of 1000/- per month the Secretary and the President not provided me the proper electricity facility/generator falcility after the electricity gone. since three months I am facing the problems.

what is the maximum time limit for elected committee to resume / take charge / occupy the office ? the law is silent on this point ?
can defeated / old committee can hold AGM ?
My query is regarding distribution of water charges among the members. Bye-laws no.69 provide that water charges should be distributed on the basis of number and sizes of water inlets provided in each flat. Our building consists of two types of flats, 1 BHK with 2 inlets and 2 BHK with 4 inlets. The variation of inlets is due to internal design and direction of pipe line. The more number of inlets in a flat does not mean more usage.There is also a provision of water tap provided from the same tank from which the water is used for Car washing. The said tap has no separate inlet. The water used for car washing is in addition to what they use from inlets in each flat.Bye laws do not mention anything about levying charges for car washing. In view of this we have obtained AGM's approval to distribute water charges equally to all members. However some of the members of the opinion that we should charge on the basis of number of inlets provided in each flat as mentioned in bye-laws. They conveniently forget that they use water for car washing also in addition to what they use from inlet.I am the Secretary of this society and I am required to face such queries. I therefore request you to kindly confirm whether the steps taken by us to charge water charges equally with approval of AGM are in order.
