[Resolved]  DBRealty — complaint against developer and builder

Complaint against Builder/Developer in Mumbai Suburb.


Developer/Builder : DBRealty in association with J.P. Developer.

I have booked and purchased a 2 BHK apartment with 1030 Sq.Ft Built-up Area in D wing of Orchid Suburbia located on Kandivali link road.

Issues as mentioned Below:

1. Area in Allotment and Agreement is not the same i.e.
In Allotment Letter carpet area mentioned for 1030 Sq.Ft flat is 665.64 Sq.Ft.
Whereas in Final Agreement the area mentioned is 647.38 Sq.ft.

I have asked the question for the same via E-mail to the Site office supervisor/sales personnel but he refused to explain.

since I am and NRI I could not manage to fight back for the same,


2. I had applied for house loan which was sanctioned in Jul/Aug 2010 @ the rate of 9.40%.
Due to delay in finalizing document the loan was pending for disbursement for more than a year
and when after lot of fighting and followup agreement was made and loan got disbursed @ the rate of 10.50%.
Due delay from DBRealty side I had to pay extra interest on the sanctioned/disbursed loan amount.

My question is as follow.
1. What legal action I can take against the builder/developer?
2. Who can help me to get compensation for the same?
