legality of bussiness

Nmart retails is promoting their mall membership by taking Rs.5500/=, please let me know that wether this is not covered under" the Prize Chits and money circulation schemes (Banning)act 1978" please clarify

according to circular no.21/22/2001 dt.09/04/2003 and d.no.21/22/2001 dt 31/03/2003 this co. not fall under category of chits money circulation.
