[Resolved]  Nokia X3 - 02 Touch & Type — Unfair Trade Practices

Address:Karnataka

I purchased a Nokia X3-02 from an authorized reseller on Feb 28, 2011. The IMEI No. of the mobile phone purchased by me is [protected]. I made an informed decision to buy the phone based on the research and reading on the company’s web site, other web pages and blogs that Nokia X3-02 phone was an OVI Music Unlimited Edition phone. I was impressed with its sleek design, unique key pad with touch UI and also its music capabilities like it being a OVI Music Unlimited edition phone, with which I could download 4 million tracks online and keep it forever.
I am a regular Nokia purchaser from the last 10 years and have been brand loyal to Nokia in-spite of the better and newer products from Apple and Android. I have owned almost all the flagship devices that Nokia has introduced in India. I recently purchased a Nokia N8 during October 2010.
I was in for a terrible shock when I tried to register the X3-02 with the Ovi Music Player, and it returned a message that the phone is ‘NOT A OVI MUSIC ENABLED’ phone. The User manual, OVI Music Limited Edition Terms and Conditions provided in the box and the Nokia Page (India) however does mention this phone as a OVI Music Unlimited Edition enabled phone. I immediately called up the customer care centre and spoke to one Abhishek on Mar 2, 2011 and he said this issue would get resolved in a couple of days. Even the brochure, which was in the box, lists out the terms and conditions of OVI Music Unlimited Edition devices.
The acts of showing the said phone to be an OVI Music Unlimited Edition device in websites, brochures and user manual provided in the box and other advertising materials, induced me to purchase the said phone. The said false statements and representations tantamount to Unfair Trade practices.
My only prayer is that I require the same model of the phone with OVI Enabled.
Could this forum address my greviance and offer me a solution.
Thanks

I am also facing the same issue. I purchased the Nokia x3-02 on 30-Mar-11 from Spice HOTSPOT in Bangalore. When I tried to register the X3-02 with the Ovi Music Player, and it returned a message that the phone is ‘NOT A OVI MUSIC ENABLED’ phone. I contacted the Nokia Customer Care thru email. They also replied the same.
The specifications given at Nokia India website clearly says this is "Ovi Music Unlimited" phone.
I send an email to [protected]@ovi.com as well, but didn't get any reply.

How to resolve this issue?

regards,

Ashok Surana (surana.[protected]@gmail.com)
