[Resolved] Royal Goan Beach Club — RETURN OF DEPOSIT | |||
Dear Sir, I would like to lodge an official case against Ms Royal Goan Beach club for refusal to refund the monies paid as deposit for their time share membership inspite of informing them immediately the day after purchase of my intention not to go ahead with the membership.The amount in question is Rs 52,000.What I want to bring to light to the honourable court is the unethical and aggressive methods deployed by the company to sell their product and preying on the customers possible error of judgement to usurp monies paid at that point.The company typically calls people in a room and informs them that they would have to take a decision at the end of the presentation or else the offer is not valid.I had taken up the offer for time share under the ‘platinum membership’ scheme that required me to pay an amount of Rs 52,000 as down payment and the balance of Rs 34,666 in 6 installments. Upon my return to Mumbai a few days later I realised that this scheme was not the same as potrayed to be by the sales person and certain promises made to me was not part of the agreement.For instance I was committed 165 points every year which entitles me to 7 nights of holiday per year in the same level of standard that was shown to me in the presentation.But what I realised that Royal Palms had only 4 of their own properties in Goa and one each in Kerela and Jaipur.The rest were reciprocal arrangements mostly with Sterling properties whose standard was certainly not comparable to what was potrayed in the presentation.Upon realising this I ha d immediately sought to cancel my membership and sent a mail on the 4th of Jan to Royal palms to that effect and had requested them to have my monies returned.I assumed that I had the right of refusal provided I sent them a request for cancellation within 10 working days of making the purchase of the said agreement.I had also then talked to several people whom I came to know have suffered extensively on account of the malafide sales practices of the company. I seek your intervention on this to have my monies returned.This company has duped many unsuspecting customers of their hard earned monies and continues to do so in total disregard of the law.Being an NRI I was not aware of such malafide practices by timeshare companies and thought that the government had brought in tough legislation to prevent such practices that was rampant in India around 10 years back.I sincerely request you to help me recover my dues from the company. Use social sites like facebook, etc or forums like this to make contact with people in similar situation as you. After you have connected with a few people come together with a lawyer and showup at the company premises also go to the local police station and file FIR of fraud againts the company also make sure you tell as many people as possible about how you were cheated friends, family spread the word as this is the only way to run these type of companies out of business.
If you make enough noise and nusiance for this company, that is the only way they will come to a sensible agreement with you. If you dont put the effort they will benefit and they will keep cheating people in a similar way again and again.
