It is now more than 2 years (June 05, 2010) my house was demolished. My family consisting of 9 members – including 3 senior citizens & 2 children have been forcefully vacated and my entire household things were dumped into a room provided by the builder. The temporary accommodation provided has also been made to vacate tactfully on April 2012. I have sent so many communications to the builder, the society and the Dy. Collector and till date there is no reply or any solution for my problem.

My house was demolished under the order from Dy. Collector Mr. Yeshwant Tidke. I therefore requested him for a solution for my problem as I was clearly sure and had provided all the documents to prove that this land is a Private land and the SRA project happening is illegal. The plot where my house was located was a Private land and therefore I demanded a house to be allotted in the Private building being constructed facing the road with an equivalent area of my house.

Last month (July 13, 2012), the so called Secretary (Mr. Joshi) of Omkar Hitavardhak Co-op Hsg. Society had shown me a letter from Dy. Registrar, SRA Office, Bandra regarding “Issue of Identity cards to 7 valid members”. There is really something fishy in this project, the society was formed of 30 members, 12 floor building is constructed even though there is no permission for construction beyond 8 floors. 15 members are shown as ineligible. Now the letter for issue of Identity card has come for 7 members only. Even before the house (flat) is allotted to the original 30 members, there are few flats in the building which are already being occupied by non-society members – how is this permissible? There were no formal meetings or any intimation to the Society members on the progress of this project. Everyone is completely in the dark, even the members who have taken the keys are still not aware what is happening on this project. They have still not got any documents in writing yet, they are given the accommodation on the basis of getting furniture done.

Therefore I am waiting for a reply from the Dy. Collector on this matter. I had written so many communications but am yet to get a reply from his side. I have also requested the Dy Collector to give order to the Builder for paying my rent as I have also been made to vacate from the temporary accommodation provided to me.

Request everyone to please support me in getting justice for my right.

After so many letters and complaints to Dy. Collector, Goregaon (last letter dated September 03, 2012) still not a single reply from his side.

I am still confused what is happening on the allotment of my house which was demolished on the order from Dy. Collector, Goregaon. My family is without an house and still waiting for a positive reply from his side. The builder has even made us vacate from the temporary accommodation provided at the time of demolition of my house and he is also not paying any rent since then. This is really injustice done to me and my family.

I am still waiting for a decision from The Dy. Collector, Goregaon. I have provided enough supporting and documents to prove that my house was under a private land and my only demand is a house with an equivalent area in the Private building where my house was located which is completely legal.

Request everyone to please support me in getting justice for my right.

After so many correspondence from my side, I have not got any reply from the Dy. Collector (Malad), submitted at Goregaon office. Last letter submitted was on September 03, 2012, still waiting for a reply from his side.
After 2 years of demolition of my house on the order from the Dy. Collector, I finally received a letter from Dy. Collector last month stating that I need to get in touch with SRA office. Now I have forwarded a letter to SRA office and is still waiting for a reply from the SRA office.

I am still waiting for a revert from the SRA office. I had forwarded my complaint to the SRA office, Bandra as per Dy Collector's reply. It is now more than 2 weeks now that I have still not got any revert.

Yesterday, Saturday April 06, 2013, Dy Collector had visited our area to do a survery of our next society alongwith the builder (Royal Realtors). The builder is planing to shift that society people into our society, How is this possible even before the people in our society have got their flats. Request you to do a proper enquiry before taking a decision on this.

It is more than 3 ½ years now that my house has been demolished (June 05, 2010) on the order from the Dy. Collector (Mr. Yeshwant B. Tidke). We were not vacating the place only on the ground that the house where we were staying was a private land and we had paid rent to the landlord till March 2009. We had even filed with RTI and got a reply that the plot is not approved under SRA. We had even written to the Dy. Collector with enough supporting’s to prove that this land was a private land and copy of RTI filing was also attached. We had met the Dy. Collector alongwith the other tenant (Raghunath S. Jadhav) whose house was also demolished.

Our house was demolished and we were forced to vacate (My family consisting of 9 members – including 3 senior citizens & 2 children). The demolition squad entered our house from the front & back door as if we had committed a crime and they took all our belongings and loaded them into a truck without our permission. Our house was demolished with the help of a Bulldozer and our belonging were dumped into a small house provided by the builder which could not even accommodate half of our belongings and they dumped the rest into another room which was provided to another tenant (Raghunath S. Jadhav) whose room was also demolished.

I did not get any documents in writing neither from the Dy. Collector, Builder or Landlord on this cruel act of demolition. I had visited the Builder’s office on several occasions and even written to the Dy. Collector but did not receive any communication from their side. It was only on 1st March 2012 I received a letter from Royal Realtors (the builder) to come and collect the keys and handover the temporary alternate accommodation provided to us. But I was not ready to vacate the temporary accommodation as I was not satisfied with the proceedings. I replied to the builder’s letter with copy to the Dy. Collector.

On April 2, 2012 I got a call from the Kurar police station to come and meet Inspector Shirsat, on reaching there, I came to know that the complaint was given by the room owner where our household belongings were dumped. On April 4, 2012, I and the room owner were called again at the police station and they expressed their difficulties upon which I also agreed to help them. The inspector said he will call the builder also and arrange a meeting on April 05, 2012. On April 05, I received a letter again from Royal Realtors to take possession of the SRA building constructed and vacate the temporary accommodation.

On April 6, I went to the builder’s office to submit a reply for his letter and there I met the room owner’s son and he said they were under much difficulty and needed the room back. Hence I agreed and decided to hand over the keys and he also agreed to take back the complaint given against us. Even though it was not our matter of concern as the room was provided to us by the builder and the agreement was between the builder and the room owner. But still on humanitarian grounds I agreed to vacate the room.

I have not collected the keys for permanent accommodation provided by the builder because of the following reasons:

1. My family were forcefully vacated from our house which was a private land and do not come under SRA (RTI filing confirmation with us)

2. I am demanding an equivalent area in the private building as our house was big, self-contained with toilet and bathroom attached and was not a slum. We had also paid rent to the landlord till March 2009.

3. We had an area of around 500 sqft, with plenty of space in the front and back with garden and trees which was fruit bearing.

4. The society was formed illegally without enough members to form society. The Annexure says total 30 members out of which 15 are not eligible.

5. No proper meeting was held, Minutes of meeting were not drafted and society members were kept in dark without any communications.

6. It is even heard that there are cases pending in the court for the title of this plot.

7. Even the draw for allotment of the so called SRA flat was done at the builder’s office and not at the plot site. We were not even aware of the draw as it was not even communicated to all the members.

8. I am still confused as without getting an OC how is it that the draw was taken on October 05, 2011 and some of the members have already taken possession of their flats immediately after the draw.

9. No proper documentation / agreement have been signed between the builder and the society members yet.

10. I have still not got any letter from the Dy. Collector as it was under his instruction my house was demolished.

These are only a few reasons for which I have still not accepted the Keys.

I have only vacated the temporary accommodation provided to me by the builder on the humanitarian ground towards the room owner. I have still not accepted the keys for the SRA construction which the builder is asking me to collect which I will be doing so only under your instruction only then I will be able to make a decision.

Now I am awaiting your decision on this matter as to whether I should be taking the keys or will you help me in getting justice for my rights. Meanwhile, I request you to instruct the builder to pay rent for my accommodation from the day I have been forcefully vacated.

I request your goodself to look into this matter seriously and come out with a positive solution and do justice to poor people like me who do not have any means to stand up and take up this matter before anybody else than you, since I am a Senior Citizen and not in pink of health.

It is now more than 3 ½ years now that my house has been demolished under your order/ instruction and I am houseless since then. I am a Senior citizen / retired and do not have anything left other than this house. I am now waiting to get justice which you could only provide.
I had clearly stated in all my previous communications and at the meeting we had with your goodself at your office the reason for not vacating. (Copy of letters enclosed)
The house where we stayed for last 44 years, on one fine evening was demolished under the order by the Dy.Collector who was Incharge and since then we are houseless and in dark. The temporary accommodation which the builder provided, where our household items were kept was also taken away by the builder tactfully and he is not giving us any rent also.

My house was under a private land, self-contained, I had paid rent to my land lord till March 2009. I had filed with RTI and got a reply from RTI that CTS No. 708, 729(pt.), 732 & 732 1 to5 is not yet approved under SRA. I had written to the Dy.Collector office with enough supporting’s to prove that this land is a private land and even submitted the reply of RTI filing which states that this land is a Private Land and not approved under SRA.

Now on this above mentioned Plot where my house was located a Private building – a tower of 20+ floors has come up and our landlord (Mittailal Pasi’s sons) have already moved their offices into this building even before making any arrangement for us. They were also in the same row house as mine. Their Room No.was 2 & 3 and mine was Room No.5. Is it not injustice?

I request your goodself to look into this matter seriously and advise the builder to allot me a flat equivalent to my actual area in the private building and do justice with me.

If you still feel that you have taken the right decision then please give me in writing to collect the keys from the builder for the SRA building which the builder has allotted for me.

It is more than 3 ½ years now that my house had been demolished on the complaint given by the society (the house where we stayed for long 44 years). Since then none of the Committee Members or anybody from the Society have ever checked with us on the progress or done anything for us.

I had written many a times to the Society seeking for clarifications but the Chairman/Secretary never bothered to reply and even did not accept the letters sent by Registered and courier.

I was also compelled to vacate the temporary accommodation provided by the builder where my household items were kept. Builder did not even provide us any rent since my house was demolished, everything I had to manage myself.

I request the society to interfere in our matter and get an immediate solution for our problem. Kindly arrange a meeting with the total society members as there is need to discuss our matter and get an immediate solution for our problem.

I have lost all my patience and will now be forced to take legal means which might then create a problem for the society members also who have already taken their possession which I don’t want to happen.

I have requested Dy.Collector to look my matter seriously and advise the builder to allot me a flat equivalent to my actual area in the private building and do justice with me. If he still feels he has taken the right decision, I have requested him to give me in writing to collect the keys from the builder for the SRA building which the builder has allotted for me.

There is no response or any communication from the Dy. Collector's office even after sending 2 reminders Match 07 and July 18, 2014. This clearly means that Dy. Collector has taken his decision wrongly which he should rectify.

Why is it that I am not able to update my complaints on this site. Yesterday, I had updated a complaint, but it is still not showing.

It is not for the first time that it is happening. I had updated some photographs also earlier in one of my complaints. That complaint also did not get updated.

Please look in to this and revert urgently.
