[Resolved]  Shree Om Sai Nath Car On Rent — Court hearing details 29th March 10

As the judge had heard 8 cases before the 9th case of Mr. Roopesh Verma could be heard he got tired & moreover it was 5 pm when the turn came & he discussed it fast & straight away gave 8th April 2010 as the next hearing date.

What transpired in between is that, police/eow has still not gave any evidence/proof of fraud & were seen discussing of the track that there is no fraud done by Mr. Roopesh Verma and are now not much eager to pursue it further either.

The Judge was also seen convinced, now based on the documents submitted in the court he knows that Mr. Verma has sufficient assets to repay everybody, but was of the view that all investors across India who have made complaints in any state/city for getting their money refunded should be made a collective application so once for all a decision/verdict/solution can be given to them. He was also appreciative of the statement by Mr. Roopesh Verma that he is ready to give every investors money as per the contract/agreement undertaken as refund & profit/compensation for rest of the 60 months period and will be running his company as per the normal operation as was earlier and also that he has 300 crores at his disposal for the same. The judge is also looking forward for a personal hearing with Mr. Roopesh Verma to fulfill his constitutional responsibility towards the legal system of our country.

The complainant’s lawyers are trying to get money even before the court pronounce verdict which was opposed by Mr. Arya. Mr. Arya has shown large nos. of affidavit of support/Declaration for support (which is still pouring in) to the Judge and is of the view that if no fraud is detected Mr. Verma should be released on bail based on such a large support by investors.

Mr. Arya also carried a cutting of Midday paper published in Mumbai (it was in Marathi) which is carrying the interview of Mr. Roopesh Verma wherein he has explained the events followed since November 2009 & has claimed he has 330 crores (latest calculation & assessment of the assets he has) which would be used to repay to all the investors. Mr. Arya would be submitting it as another document/statement given in public by Mr. Verma towards the genuine support towards investors cause.

Sosn Investors Forum view point:

Dear Investors Friend,

It was long back anticipated by the members of the forum (not made then & still it is virtual) that such situation will arise wherein investors of other state/cities after filing complaints will still have to wait & suffer as their complaints/FIRs will only result in inordinate delays. Now if the police/eow in Delhi is of the serious opinion that no fraud is committed and is yet to submit substantial & concrete evidence/proof for the same other then the no. of complaints only; the investor’s are still in doldrums. Even the police/eow is also helpless some sort of (they are doing their duty) & are in a catch 22 situation to go further or withdraw over. Based on complaints now it has secluded to only a case of IPC 420 cheating (no evidence/proof for IPC 406/409 & 120B has been made available till today) which also does not seem to stand its ground because complaints can be motivated and also to defame, bring loss to and/or might be because o[censored]lterior motives by the complainants (wherein the complainant’s could also be penalized).

Now the twist is the Judge view; that all investors across India who have made complaints in any state/city for getting their money refunded should be made in a collective application. We appreciate that, but who will do it, ideally it is Mr. Verma who should file a writ petition and centralize it either to Delhi or Mumbai but then the complainant’s from all other cities/states have to run around & on flimsy ground by various lawyers (a lawyer will earn 10 times what is due of the complainant’s claim – they have right to do so) the court will carry on giving dates as is happening in the eow cases running for last 10 years (source – eow website).

Other solution could be:

Every complainant (if they are serious to get their money back) along with the supporters of Sosn & all those who are still neutral should collectively make a Pan India Investors Forum & through an senior advocate give a presentation to the honourable Judge to discuss the matter face to face with Mr. Roopesh Verma under direct authority of the court & finalize a 5 point action plan that could be:

1. Refund of Principal/Invested amount after deduction/no deduction within a stipulated time period as agreed.
2. Payment to be started for profit (+ EMI)/compensation per month by a mutually agreed date, also if past dues can be given or the period extended by same.
3. Company is given full liberty to run it in normal operations, all offices de-sealed, Accounts de-froze, authority extended under court supervision for monitoring.
4. Company should be allowed to launch its applicable schemes if it so wishes because rotation of funds would be required for normal operations & smooth functioning and future growth of the company so every investor is benefited.
5. All the complainant’s after satisfying themselves on the refund of principal/ Invested amount and/or start of profit (+ EMI)/compensation per month would have to give a withdrawal of complaint letter/application to the appropriate authority & no pursuance of the same in near future.

Now it is upto the Investors to decide whether they are ready to tread on a path of thorns for long & wait endlessly to get their money back for coming 8-10 years or would like to give an opportunity to themselves to act & decide fast & through the court intervenes & directions get their money back as Mr. Roopesh Verma is ready to give money and have the assets for he same.

Please convey what we investor should do as we have database of investor(which is in progress) so that we can close the case on 8th itself and make the company running .Using the city wise database we should act collectively to roll back the cases that has been made against Mr.Verma.We shouldn't wait for judges decision but pressent the case which will bring release of Mr.verma.
It is investor who have invested in last 8 months I suppose who have made complaint ...Please suggest after consulting Mr.Arya and Mr.Verma a solution to close the case on 8th April
i am waiting for mr. verma and i also appreciate his atitude to run his company again . i m from lucknow u.p. and i m only 25years old . i hav 2 plans of company (3,[protected], 633/-per month )&(1,[protected]/-per month). i know this is not the end of my life. if sosn will run i will again invest more money.

We are thankful to Mr. Anil for providing info on the court hearing held on 7th September 10. Further to add a settlement formula has been made by the complainants & Mr. Rv lawyers which as per the committee to be formed under the Chairmanship of a Retired Judge Justice Chopra will receive the suggestions & objections to the settlement procedure of distributing balance amount of principal amount amongst the Investors. As mentioned the Committee will comprise of lawyers (both parties) Representatives from SOSN, EOW and elected representative from the Investors Forum (If any).

The only lacuna is that in the absence of any elected representative from Investors Forum (which is not formed any where in the country, if any we are not aware) will certainly going to harm the interest of investors at large. We are also susceptible of non-investors and even persons with vested interest taking the advantage of the same & harming the interest of genuine investors.

As there was a request by the complainant's lawyers to cater to the need of their clients first but not accepted by the judge will again try to press their demands in the committee (which they are going to be members of). We request eminent personalities from varied facade of society having good standing & if have invested amount in SOSN to come forward & take the challenge of getting a true and empathetic settlement & justice to the affected investors brother n.

The court does not have any reservations to Mr. Rv running the company after getting bail & taking investors into confidence as there was no cheating, embezzlement of funds and criminal conspiracy on the part of Mr. Rv & co. only some overzealous investors with the connivance of some lawyers has got him arrested & rest is history. Mr. Rv & team is also of the same opinion as everything was very much legal & as per the law of the land.

Mr. Rv is expected to get bail within the next one to two hearings following the formation of the committee & execution of the settlement procedure. Nexthearing is on 9th September 2010.

We are thankful to our Investor Members like Mr. Anil & Mr. Manoj who have taken up the cause of providing details of the hearing of sosn case & are also trying to support investors to form a group to help Investors across India.

First the details of the hearing; as the time given was 2.30 pm most of the investors, I.O., Mr. Rvs & Mr. Av lawyers were outside the court room discussing modalities of getting bail to Mr. Rv & exercising restrain on the onslaught by some of the complainant’s lawyers.

Finding it an opportunity, some of the complainant’s lawyers presented their case first in the court without waiting for rest to join & openly challenged the chances of Mr. Rv getting bail on the ground of ready to pay the amount available with the court to the investors & not to their clients first also they started objecting to the MOU made wherein Retd. Judge Mr. RC Chopra would head the committee & not finding their names as committee members.

Mean while rest of the complainant’s lawyers joined & they started fighting among themselves who should get the amount first by becoming the member of the committee based on nos. of clients they represent and to divert the attention from the merit of the arguments of bail & instead they even claimed the session court does not have authority/jurisdiction to appoint/direct the Retd. Judge Mr. Chopra to head the committee & report to court on the progress time & on.

By then the lawyers Mr. Rv & Mr. Av Mr. Ramesh Gupta, Mr. JS Chowdhary & Mr. Aman Sareen joined but as most of the damages were done they were not able to persuade Judge Mr. Garg to grant interim bail as even some complainant’s lawyers claimed that Mr. Rv will run off & all the amount confiscated by the court will get forfeited till Mr. Rv is rearrested no point giving him bail now.

The Judge finding it tough on many issues kept his judgment on bail reserved till the issue of forming the committee & repayment of amount to the investors start & transferred the case back to the trial court for the same though suggesting that he will recommend the lower court to bypass earlier objections it had & look the same in a fresh & positive manner.

The next hearing date is 13th September 10 & will be in the lower court at 2 pm.

WHY RS. 15 CRORES should be used to clear the dues of Delhi Investor's only. It will be a sheer injustice with other investor across India. Why the sosn company is not putting the detail's of all the investor's across India before the Hon'ble court. In my view the total balance invested money of the investor's across India should be calculated, then the asset's and cash with the co. After then it can be decided by the court that what should be the way to protect's / return the fund's invested by the crying investor's throughout India, and if this thing is not taken into consideration then it will be a blot in the name of justice. So it's my request to all investor's across India that in every city where the sosn co. was running his business one DEDICATED PERSON should come forward along with the data of the Investor's of his city. In this way the total balance INVESTED MONEY can be calculated. So be hurry and don't waste the time till then from every city a request should be forwarded by the POLICE/EOW to the Delhi Court before Hon'ble Judge Mr. S.P.GARG not to grant any bail .
