Emcon Enterprise — Adv not refunded by supplier for incomplete work

I had given an amount of rs. 8000/- (Rupees eight thousand) to ujjal kumar roy, owner of emcon enterprise at 21/1, satyajit park, thakurpukur, kolkata-700063, on 1st may 2017 through online bank transfer (From my a/c no. [protected] kotak mahindra bank, park street branch to ca a/c no.[protected], canara bank, bhowanipore branch as advance payment for acp work at my commercial space at 219, ho-chi-minh sarani, shakuntala park, kolkata – 700061 as agreed and mentioned in his quotation/estimate.
Mr. Ujjal roy was started his work on 2nd may, but on the next day he discontinued his work and assured me to finish the job by 5th may. After 5th may, he again started to give false commitments in phone and mails (Proof attached) to finish the job and final date was given on 10th may to complete the work. On 10th may, he did not complete the work and also did not inform me anything and when i was tried to contact him on his all numbers, but none of his phone numbers were uncontactable. On 11th may, i decided to cancel the job and ask him to refund the balance amount from my advance amount of rs. 8000/- after deducting the amount of partial work done by him. He agreed to refund rs. 4710 (Four thousand seven hundred ten).
After that he again started not to receive my calls and did not refund that amount and gave false dates again. After several attempts to recover my money, finally, he assured that he would refund me by 31st may 2017. But he did not do anything till date.

The police station has done a general diary against mr. Ujjal kumar roy of emcon enterprise (Mobile nos. O[censored]jjal roy are [protected], [protected] & [protected].

Kindly help me the way of getting the above money back
