Indian Railways — Central Administrative Tribunal OA order No.[protected] dated 20.10 2008 not Implement by DRM-NCR-Allahabad.

To, Dated: 18.07.2014 Hon’able Minister of Railway Ministry of Railway, Govt. of India, Rail Bhavan, Rafiq Marg, New Delhi. Sub: Application for implementation of Central Administrative Tribunal order of 1341 of 2005 dated 20.10.2008 and contempt order no. 29 of 2010 dt 10.11.2010, but North Central Railway not implementation the same. Respected Sir, With due respect I beg to say that I have submitted some few lines under your kind control for consideration prompt action against Central Administrative Tribunal order and contempt order. That I appeared Central Administrative Tribunal for my service disputed case because Divisional Railway Manager still harassment in 1972. My service was continued regular service from date of appointment as substituted Khallasi dated 06.11.1969. But the Railway Administration by Division were shown my date of appointment as 13.03.1974. In that case I moved so many mercy applications to my higher officer like Divisional Railway Manager and senior Divisional Personal Officer, North Central Railway, Allahabad for correctness of my service record and fixation of my pay since my date of appointment but they were not correctness the same. So that I was went to Central Administrative Tribunal, Allahabad for decision. That as per Central Administrative Tribunal, Allahabad passed the order in OA No. 1341 of 2005 of dated 20.10.2008 that in order sheet on para no 10 that I accordingly direct the competent authority to reconsider the case of the applicant with regard to counting his full previous service from 06.11.1969 to 15.12.1974 in the light of letter dated 11.02.1997 and Railway Boards letter no. E-NG-II-2006-SB-8 dated 25.07.2006 produced today and decide the date of appointment of the applicant for all purpose ie qualifying services for retrial benefits, seniority and other consequential benefits admissible to the applicant under rules” and in contempt order no 29 of 2010 dated 10.11.2010 were mentioned that as per OA no. 1341 of 2005 on 20.10.2008 definite finding was given that date of appointment counting full previous service from 06.11.1969 to 16.12.1974 in the light of letter 11.02.1997. They have perused the Judgement of the Tribunal passed in the OA and this point raised and considered and finding order the date of appointment of the applicant shall be 06.11.1969 and not 13.03.1974 and order were quashed in this connection. In the other circumstances deciding the original matter, thus, points cannot be disputed a definite finding in the OA. That in this stage finding recorded above, it is provided that one month time is allowed to make compliance of the order in letter and spirit of the order passed in the OA. There must be no ‘if and but’ in making compliance of the order of the Tribunal and immediately implementation the same. That both the order sheets letter received by Divisional Railway Manager and Sr. Divisional Personal North Central Railway, Allahabad after that Sr. Divisional Personal North Central Railway, Allahabad given a letter as letter no CS-DPO-CG-CL IV-S-3177 dated 20.01.2011, they mentioned on letter that my date of appointment as 06.11.1969 as an post of Substitute Khalasi which was clearly recorded in service book and earned increment time to time and worked up to 13.09.1972 as regularly and also further period 14.09.1972 to 08.02.1974 marked absent. That when the Central Administrative Tribunal, Allahabad passed the order in OA No. 1341 of 2005 of dated 20.10.2008 than after no any comments or served regarding beyond of Central Administrative Tribunal, Allahabad order. The Railway Administration only carried out the order which was passed by Central Administrative Tribunal, Allahabad and contempt order. That I was again to moved mercy application to DRM-N.C.R-Allahabad regarding above letter which was written to me by Sr. DPO-Allahabad. After that Sr. DPO-N.C.R-Allahabad another one letter sent to me as letter no. E-EO-1-D K Chakarvorty-court case-09 dated 25.03.2014 and mentioned on the letter that I was appointed as an post of Casual Labour and worked as part time work from 06.11.1969 to 30.01.1972 in Casual labour and 14.09.1972 to 08.02.1974 out of Railway. The both letter were challenged to Central Administrative Tribunal, Allahabad by the Railway Administration Sr. DPO-N.C.R-Allahabad and also not implementation the same order upto still date. Sir, we are all governed by Indian Law and we wrights to follow up Indian Panel Court Law and President Law without failure. The Court were supreme power to negotiate any disputed matter and pass the order for implementation, so that anybody government staff were not authorised any comments and challenge on behalf court also cannot ignore their orders any cost which was shown as legal or in-legal case. We are not authorised to challenge to the Hon’able Justice of the judgement, any criticized, or any other legation on behalf of Indian judicial. We are governed by Indian Law Constitution. Sir, we are Indian and our first duty to due respect any cost of the Judicial and President of India. Indian Law Constitution was over all superior in every corner as employee or others public sector etc. Sir, I humbly respected and pray to you Sir, with folding two hands as retired poor employee that may kindly see to my case and set up enquiry as above original facts and passed the favourable order directly instruction to Railway Administration, Divisional Railway Manager, Allahabad for implementations of Central Administrative Tribunal of court order as O.A[protected] dated 20.10.2008 and fixation as per third pay commission. In Third Pay Commission which was clearly mention in GSR-516-E that on fixation time pay will be 1969 to 1973 i.e 196/- due to same slab and further pay will be raised one step up fixed on 1st Jan’1974 i.e 199/-. So I request to you kindly passed order for re-fixation as per third pay commission my pay will be fixed as on 1st Jan’1974 as 199/- with arrears payment from on 1st Jan 1974. God help you. Still no result found up to still date by the DRM/NCR, Allahabad. Hence I will be moved again High Court regarding the same against DRM/NCR/Allahabad.
