I, Hiren Kumar Vyas would like to raise my concerned towards the unprofessional and unethical behavior of the Department of Postal Life Insurance, Competent Authority has rejected the claim for suppression of pre-existing medical history. I would like to appeal this decision on the grounds that it is unfair and unjust.
At the initial stage, the payment to above policies was refused on the ground of suppression of medical history of my wife who expired on 30/10/2022. I have represented against the decision vide letter dated 22.04.2023 copy enclosed. It was said that the decision was premature as it was taken one sided without issue of show cause notice to either party. Even the decision was uphold by you stating that claimant was suffering from Cancer but before a decision was taken, no show cause notice issued. The mandatory provisions of law are violated. However, I am representing against your one sided decision without offering an opportunity to representation as under.
With due respect, I am to state that I have taken above policies on 11/01/2021. My wife expired due to CARDIAC ATTACK while her treatment Cancer was on, is a fact of paper which I submitted to Postal department. Postal department decision to regret the claim amount with pre-belief that she was suffering from Cancer on the date of taking policy. You have to show cause me with paper proof that she was suffering from Cancer on the date of taking policies. You have to prove on paper of her suffering from Cancer on the date of taking policies i.e on 11/01/2021.
I am to say that she was keeping not well in the first week of April 2021 and our family physician directed us to have through body check up on suspicion of suffering from Cancer. Before arriving to the conclusion, She was undergone kemo treatment in the month of May 2021. She was then diagnosed as suffering from Cancer on 17/06/2021. Her treatment started then. She was admitted to hospital on 23/09/2022 and after prolonged treatment she succumbed to her injuries due to CARDIAC ATTACK on 30/10/2022 while the treatment of cancer was on. I have submitted all papers of her treatment to the postal department.
It is wrong on Postal Department part to assume that she was suffering from Cancer on the date of applying policies on 11/01/2021. She was well while taking policies and cancer was detected after wards. We have correctly given Data while taking above policies and have not suppressed her medical history at all.
In view of what has been stated above, it is crystal clear that we have approached with clean hands and have not suppressed her medical history.
