I submitted my RC book and NOC for my car at Kolkata RTO through Mukesh Hyundai, Keshtopur Kolkata in 2018 for number change from Karnataka to West Bengal. We were asked to coordinate with the agent at the Saltlake RTO. Every time we called, either he did not pick up or if he did receive the call he would give a future date to call and coordinate when to come. This went on till end of 2018 and then Covid-19 came and he stopped answering calls. We followed up with Mukesh Hyundai employee to resolve this but he started ignoring us too. Hence we were only left with a seizure list and pollution papers for our car.
Finally last month, we wrote an email to the Mukesh Hyundai employee asking for our car documents and money. He returned 50000 Rs. (of the Rs. 66000 we paid him) and said that he had already paid 16000 to the RTO. He asked us to write an application and go to the RTO to collect our papers. Now when we visited the RTO, the agent is denying to return the RC book and NOC. He says why are you coming after so long, we can't return papers. After a lot of requests, he says that you have not paid the tax at WB for driving the car here, where I had already paid the lifetime tax at Karnataka for my car. We understand, he is basically looking for more money. Can the RTO seize original papers even when there is no law or traffic violation? how can we file a court case in this instance?
