[Resolved]  Advocate Apollo Moghe — Unprofessional advice, lacks basic subject knowledge

I wish to file a complaint against Advocate Apollo Moghe, who was consulted by my housing society regarding the transfer of my late father’s share.

The advice provided by the said advocate was incorrect and misleading, as a result of which my legitimate share transfer has been stalled for over two years.

After carefully studying the applicable provisions and with proper references, I was able to prove that his advice was wrong on almost every point (except one or two points).

When I raised my doubts and messaged him regarding his legal opinion, he did not respond instead asked me to contact another member of my society. Later, when I called him for clarification, he did not answer my calls.

Such behaviour is highly unprofessional and unbecoming of an advocate, since my society's committee was entitled to receive accurate and correct guidance.

Because of his negligence and lack of responsibility, I have suffered unnecessary delay and mental stress. I request that appropriate action be taken against him for:

1. Giving incorrect and misleading advice,

2. Failing to respond to client queries, and

3. Causing undue delay in a genuine legal matter.

I sincerely request you to look into this matter and initiate disciplinary proceedings as deemed fit. If required, I shall raise the issue with the Bar Council of India soon.

I am in possession of documentary evidence in the form of letters issued by my society’s managing committee, to which the legal opinions of Advocate Apollo Moghe were annexed. I also hold references from the relevant provisions of law which clearly establish that the advice tendered by him was incorrect and misleading. I shall produce them if and when required

One critical example is when our society sought legal advice regarding the documents required for transfer of shares. As per Section 154B-13 of the Maharashtra Co-operative Societies (Amendment) Act, 2019, it is mandatory to obtain at least one of the four specified documents for a valid transfer of title. In the absence of such a document, the transfer would be rendered void under Bye-law 38(d) of the MCS Bye-laws. However, the advice provided made no reference to Section 154B-13. Had we or the society relied solely on this advice, our transfer would have been void, causing significant complications for any subsequent transfers

Another significant instance relates to our application made under Bye-law 33 of the MCS Bye-laws. As per Bye-law 38, if the society intends to reject our application, it must provide specific reasons for such rejection within three months of the application, before invoking any other bye-law against us. Otherwise the transfer is deemed done. We never received any such communication nor was our application non compliant with bye law 33. Further, under Bye-law 34, the requirement of publishing a newspaper notice is expressly imposed upon the society, with claimants or applicants being required to respond to that notice. The language of the bye-law leaves no scope for compelling applicants to undertake such publication themselves. Despite this, Advocate Moghe advised the society that it could compel the applicants to issue newspaper advertisements, which is contrary to the clear provisions of the bye-laws.
