Under Instructions from and on behalf of our client, we hereby serve upon you the following notice:
1. That, vide invoice dt. 16 June 2021, I purchase a Laptop i.e. HP Notebook-15s-du1044tu Intel Core Celeron|N4020|4GB|1TB HDD|15.6in|W10|INT| Jet Black 1. IMEI/Serial Num –CND1115L27 from Noticee-2, for my son.
2. That, the product was delivered at my address on 19 June, 2021. Since, the 1st day the performance of the product was not upto date. Several issued occurred, i.e. day by day it became slow, became overheat, hang, buffering & paused for longtime, sometimes it not starts/ boot and became totally black. During Online Class & Video Conferencing, every short times, it disconnected. But at the same times other devices works smoothly on the same network. Due to which we faced grave hardship everyday while using this product and my son forced to do his class on mobile phone. .
3. That, many time I and my staff contacted to Noticee-1’s representatives through its customer care. Initially, the representatives of Noticee-1, stated that they have no concerned with this product as I have purchased this from ‘TATA CLiQ’/ the Noticee-2. They, advised me to contact to TATA CLiQ/ the Noticee-2’s customer Care. When I asked them to give the same in writing, they denied.
4.That, anyhow on 06/11/2021, I could have spoken to one the Senior Representative of Noticee-2. He assured to help and initially he tried to check & Recheck the device and short-out the problem through online. But when could not resolved, he arranged pick-up to sent the product to Noticee -1’s service center for diagnose and maintenance/repairing.
5. That, the product was picked on 08/11/2021 and was delivered return back to me 11/11/2021, at noon. When the product was returned I switched on the Laptop in the presence of the delivery men and again it started overheat within the seconds. Then delivery boy asked me to speak to service center and I made the call to concerned person who worked on the product. He stated that he has re-set the laptop and re-installed driver but overheating problem cannot be cured. He said whatever he can do he has already done.
6. That, having no option I received the product. But when I son used it the functioning of the laptop has become worse than earlier. Now I have totally became fed-up with this product by day by day problem. I have already used and using another product of Noticee- 1 but unfortunately, I would say that this product is not upto mark and there is some manufacturing defects.
5. That, abovesaid facts and circumstances show unwillingness, negligence towards your customers and also deficiency of service on your part as you have sold defective products stated above to me. Thus, for the same I am entitled to be compensated from you for the abovesaid mental agony faced by me every day, when I and my son used your abovesaid product. Now I have no option except to purchase another product of other company or other model. Therefore, I am requesting you please take back your product and refund my total amount paid by me at the time of purchase i.e. 27490/- or replace it with your successful model with in period of one week from the date of receipt of this Notice. Falling which I will have no option except to initiate legal proceedings against the You Noticee as per Law and Noticee will also be liable to pay me Rs.50, 000/- as a compensation for the abovesaid mental agony to me and my son and also Rs. 50, 000/- for waste of my time every day.
A copy of this notice has been retained in my office for further references.
