Sub: Cancellation of 1 BHK booking of Gulmohar Project

Dear Sir,

This is Ananya Mondal, Wife of Mr. Nandalal Mondal who booked one 1 BHK flat of Gulmohar project . We have given total Rs.50000 in two part as advance for the booking on 11th Dec, 2016. We have visited three times to your projects but we found no growth at all as per your big project and commitment of giving handover 2019. However of our last visit yesterday to your office and the project place we found there are many wrong commitment given to us at the time of spot booking. Also we found there are changes of person whom we have made the booking. We spoke to Mr. Dipayan at your office yesterday and we have asked him to cancel our booking and to refund our advance payment, as per him he cannot refund the amount before 2019 or maximum 8 months from yesterday. He was not willing to give any cancellation document or his visiting card or written document of refund process .As per him he will deduct 15% of the total advance amount and balance will be refunded. Anyway we want to cancel the booking for wrong commitment to us and we want the advance payment to be refund to us within 31st March 2018.

We except a gentle reply on the same and we wish to get the payment within 31st March, 2018 as this is hard an soul money to us.

N:B: I have sent this cancellation mail on 8th Jan, 2018 but after following up with Mr. Dipayan no reply I have received yet, nobody is willing to transfer the line to accounts department for the same. I need your help to get this payment.

We are talking with Mr. Dipayan for refund process and it will be done soon as per his verbal commitment and we are satisfy with talking to him .

I dont think Mr Deepayon statements are satisfactory in nature. I have been talking to him for a year and he is telling that, money will be refunded. They have been holding money of many investors. I am aware of 3 others. I dont know where the problem is? I am sending a friend today to ask for the money again.

I also booked a flat in this project ( Gulmohar ) on July 2017 and the result is same as yours.

I booked 2 flats payong Rs. 2 lakhs by cheques on 27/11/2016 & 28/11/2016 and cancelled booking in April, 2017 demanding refund after deducting 15% as per their norms. They confirmed me to refund the entire amount by Aubust & September mentioning their norms. But after great persuation I only received Rs.25, 000/- till date. We also booked a flat in this project ( Gulmohar ) on July 2014 and the result is same as yours.I visited their office for refund many times but no result.
Today I was checking site of Consumer Affairs West Bengal to file a complain when saw your post. I am filing a online complain in Consumer Affairs WB site and also a FIR in New Town Police Station.

Here I can see only number of Sankar Kr. Saw so I will contact him and I am also giving my phone number if anyone wants to contact me . I am ready to go to there office whenever you want .
Not sure how many of you know they have changed their office from Chinarpark. Now their new office is in Astra Tower near Akankha More, New Town, 7th Floor, North Tower, Room No. 706.

I also booked a flat in BACM Gulmohar project and also gave them Rs. 1, 75000/-. Repeatedly I called and visit their office and request them to give my money back but till date nothing happen. They shifted their office from Chinar Park to Astra Tower building, City centre-2, New Town. I visited that office last year before pandemic and their Mr.Sinha told me that they will refund the money in Jul-Aug 2020. Now, their phone number not working also I don't know their office is there or not as I Am living out side Bengal it's very difficult for me to visit again and again.
