Hi,
I am writing to formally lodge a complaint against 'BMT Group' regarding the Annual Maintenance Contract (AMC) I purchased for my chimney.
I took an AMC from the company for 2 years covering 6 services, starting on 07/04/2024.
Despite the contract, I never received any proactive call or service from them.
On 04/12/2024, my father (aged 72) contacted the company to request servicing. They asked him to send the bill copy to their phone number [protected], which he did. However, no technician was sent even after multiple follow-ups.
On a recent call, the company’s representative (possibly the owner) verbally abused my father. When I contacted them to address the issue, they responded in a hostile manner, saying “ami k apnake bujhiye debo instant. apnar area te apnar local police station a jan” (translated: “I will show you who I am; go to your local police station and file a complaint, I will see”) and outright refused to provide the service.
Only after I warned them about legal action did they reluctantly agree to provide service, but not immediately. Given their unprofessional conduct and threats, I no longer feel safe allowing them into my home.
This behavior amounts to:
Breach of contract – failure to provide AMC services.
Deficiency in service – ignoring repeated requests.
Harassment and verbal abuse – unacceptable treatment of a senior citizen.
Threatening conduct – creating fear and intimidation.
Relief Sought:
Full refund of AMC charges paid.
Compensation for mental harassment and misbehavior, especially towards my elderly father.
Assurance that such misconduct will not be repeated with other customers.
I request immediate action against the company under the Consumer Protection Act, 2019 for deficiency of service and unfair trade practices.
