Brigade Enterprises Limited — delaying the paperwork after getting the 10% booking amount for purchase of flat and misleading the customer on gst and cost of property

We booked the flat which is a ready to move in apartment on 23/feb/2020 by giving 1.98 lakhs cheque to the builder on a pretext that by may 2020 we will get the possession. The flat had occupancy certificate.

Suddenly the builder/sales team started delaying the booking quoting "internal issues" and kept postponing the booking of the flat.

Finally the builder booked the flat around 26/april/2020.

On 29/05/2020 we paid complete 10% to the builder with agreed registration date as 23/06/2020. Builder promised that this is feasible and they will complete the agreement letter and send me for signing.

Builder send us an agreement letter in which pan was incorrect, hence we could not get the agreement letter signed on time. We asked for correction but builder did not send the corrected agreement letter till date.

After multiple reminders we did not receive the agreement letter. We finally started asking for compensation then let came up saying that

: "with reference to your mail, we would inform you that we have received occupancy certificate for crimson block hence we should not collect the gst for club house, esw charges, property assessment and gas connection all this milestone will be taken to total consideration. New cost sheet will be shared by ms. Naveena to you. Hence agreement will be changed as per new cost sheet, request you to handover the agreement to naveena we will do changes after lockdown and send you agreement with changes."

The flat and crimson block already had occupancy since dec 2018, even then we were initially asked to pay gst on various components. Which is the act of 420. Even after knowing they tried to do fraud with us. Sales team tried to confuse us and ask for higher price with gst even after having occupancy certificates.

Now after lot of discussion they agreed on sending draft agreement on email. Saying that their legal team has reviewed it (On telephone).

We reviewed it again and again we found lots of discrepancies mentioned below :

1. Page 4. Talks about occupancy certificate of amber block/blue block but does not talk about occupancy certificate of crimson block in the same context where we are interested to buy the flat.

2. Page 4 registration no wrongly mentioned as "pr/kn/170731/000503" which is actually acknowledgment no. Please provide the right registration no. As prm/ka/rera/1251/446/pr/171016/000503

3. Registration certificate of the project "crimson block" is valid till "30/06/2019" where as it is mentioned in the document that "the said registration is valid and continuing as on date." this needs to be corrected. On page 4.

3. Page 9, point no 1.13 talks about tds @ 1% which government has reduced to.75% (Already discussed earlier)

4. Page no 22. "schedule a" mention below address

"all that piece and parcel of the industrial land known as plot no 5-c of donnanekkundi 1st phase, industrial area situated in survey number 73 (Part) of doddanekkundi village, k. R puram hobli, bangalore east taluk, bangalore district"... Here "donnanekkundi" does not exist as location in india. I think it should be doddanekundi. Please confirm.

5. Page 3 under witnessth point b again "donnanekkundi" is mentioned which does not exist as location.

6. Page 23 schedule c, the conversation is wrong (339 sq. Feet (31.19 sq. Mt) it should be 31.49 sq. Mt. Please double check the conversion mentioned on the other pages.

7. Page 23 schedule c the total does not comes to be 1174 sq feet (Carpet area, proportionate share areas and other areas of common use)

8. Floor plan says 1170 sq feet, where as area confirmed earlier was 1174 sq feet.

9. Schedule h missing again (Already discussed earlier)

10. Same as point 6 and 7 (Mentioned above) needs to be corrected in document p-0261 poa. Pdf in schedule c.

11. Same as point 4. (Mentioned above) needs to be corrected in schedule a of the document p-0261 poa. Pdf

12 total share incorrect mentioned in schedule b

13 in-correct pan no of chetana dixit first owner (In the earlier hard copy send of agreement)

14 pan no missing in agreement of co owner (In the earlier hard copy send of agreement)

Due to above discrepancies the allotment letter is continuously getting delayed. And the builder is not ready to pay us the compensation for the deliberate delay. Also the builder tried to cheat us on gst.

Till date i have not received the allotment letter, i pay the rent and loss interest on 10 lakhs already paid. I was promised possession by may 2020, on the same pretext i booked the flat. The builder is sitting with my money and doing nothing in the customer favour.

Due to brigade enterprises limited (The builder)'s inefficiency and negligence the delay has happed, as a customer is should get the compensation for my losses due to poor services provided by builder. Also to again mention brigade enterprises limited (The builder)'s tried to sell a flat with gst on various component where as it already had occupancy certificate. We were nearly cheated.

1) the cost sheet with gst where brigade sales team tried to do fraud.
Gst asked on component like club house, esw charges, property assessment and gas connection.

I ask for compensation of the rent near 30k per month i have paid plus interest on the 10 lakhs amount paid to brigade for delay that brigade did due to poor service and tried to cheat customer quoting higher price of the flat with gst even after getting occupancy certificate.
