I had booked an apartment in N D Laurel, Varthur road (B Block #103) on 28 Feb 2013. I paid RS 1 Lakh as the booking amount. I paid the booking amount only because their sales agent insisted that they will give the agreed rate of 3600 per square feet only if I make the payment.
Thereafter, I went for Legal scrutiny of the documents related to the property. On careful legal scrutiny by one of the expert advocates, I received advice not to purchase the apartment.
Here is a short summary of the property (235/5 Gunjur Village, Varthur Hobli, Bangalore East Taluk) where the apartment complex is built:
The property belonged to Thimmaiah and wife Lakshmamma (in 1944). Thimmaiah and Lakshmamma had four Sons: Appi Reddy, Mari Swami, Venkata Swamy and Krishnappa. Through an unregistered Will dated 1962, Lakshmamma gave the property to Venkata Swamy. The property was mutated in the name of Venkata Swamy in 2006. Suresh Reddy, Son of Krishnappa reddy filed an objection and was settled in 2007. ND developers entered in joint development agree ment with Venkata Swamy.
As per the geneological tree (certified by Village accountant) Appi reddy expired before marriage, Mari Swami & wife had no children and are also expired. Krishnappa redy's only son Suresh Reddy entered a settlement with Venkata Swamy. In summary, Venkata Swamy's claim to the land is the unregistered will in 1962 and that there are no other survivors other than Suresh Reddy.
The expert advocate easily detected shaky grounds of the documents and strongly advised against the purchase.
For a second opinion, I approached another advocate. After a few days of thorough scrutiny, that adovate also reached the same conclusions and suggested against the purchase.
As a customer, I have the responsibility of legal scrutiny and have the right of choice whether to purchase or not.
So I wrote a cancellation letter to ND developers. After a few days I got an email back from their customer relations manager. The email says that as per the document I signed at the time of booking, they will charge 50 thousand as cancellation charge. In addition, the remaining 50 thousand will be paid only after they find another customer for that apartment.
This is clearly a total violation of customer rights. First off, they are selling something without the proper legal rights and they are charging me a hefty amount for something I didn't buy!
Therefore, I request ND developers to give me the full refund of RS 1 Lakh
No money is returned from ND developers so far.
