[Resolved]  Swaraj Builders - Lagoona Project, Navi Mumbai — Not refunded the booking cancellation amount

In our case we were interested in this project but the problem occurred from your end, you have not received the 4th floor plan approved. So as per the 3rd point in your "Terms and conditions of Provisional Reservation" you are liable to refund the same. We have booked the flat on 8th January 2013 and cancelled the same on 30th September 2013. We were kept in the dark since March 2013 that they have not received the plan approval completely and no Nationalised bank is providing loan. They were very eager to sign a letter from their part where as customer we should not force them for refund and it can be done as they wanted as per their Legal Advisor. We refused to sign the same and emailed them the cancellation on [protected]@swaraj.co.in as per Mr. Sandeep. To my Surprise they are not even attending the calls. We tried calling their Office but the receptionist is so pathetic that she is not ready to transfer the call to the concerned Sales Representative Mr. Sandeep - [protected]. He too stared ignoring my calls and attended when I called from another number. We also visited their office and now you are saying that they can refund the amount only if some other investors will invest then only they can roll the money and pay us back. More to my surprise they say that they can refund the amount in 60 days time only. They also offered me to pay the full amount in cash and not to register the same & when in near future the 4th Floor plan will get sanctioned then I can register the same. How can I trust them? In their "Terms and conditions of Provisional Reservation" it was never mentioned that after cancellation the amount will be refunded in 60 days. That is none of our concern, we want our money back as we really need to invest in some other property and pay them on 1st November 2013. We are investing for stay purpose not for business.
