CBC Corporation India Pvt Ltd — Avoid mr. durgesh sharma's, managing director, apartment at hafeezpet

We happen to be the unfortunate tenants having occupied his apartment for a little over one year. The address and details of the apartment are given as below.

Owner: Mr.Durgesh Sharma
No.407, Emerald Block
Jai Devi Homes
Opposite Hanuman Mandir
Old Hafeezpet
Hyderabad

This property is situated below the Hafeezpet overbridge and to the adjacent right of Green Bawarchi. It is situated next to the Mosque. The apartment is a 3 BHK.

The owner’s name is Mr.Durgesh Sharma (the name given in the board of the apartment is Glory Sharma, his wife), who lives in Mumbai and claims to be the Managing Director of CBC Corporation of India. Though he owns the property and signs the contract, usually negotiations is done by his friend in Hyderabad.

The problem being presented here is in receiving back the security deposit. While it was agreed that they could deduct a small amount towards repairs and breakages, Mr.Durgesh Sharma kept the entire advance amount with him, illegitimately earning the interest on that amount. While the contract makes no mention of automatic increase in rentals after a period of one year, Mr.Durgesh Sharma arbitrarily demanded increase in rentals around the time of notice period. While this is not agreed to, he held on to the entire amount. He delayed return of the advance amount by asking irrelevant queries about previous months’ payments, then raised queries on payments to association, electricity etc and finally went silent for long period without speaking about return of advance amount. No sooner I informed him that I am approaching police, he panicked and returned part of the amount but still held back the rental increases that he assumed I owe him. However, please note that there is no oral or written agreement from our side, nor is it part of the Contract itself. As you know, there are no laws that stipulate annual increase of rent, nor are there any such local laws at Hyderabad.

Hyderabad is a renter’s market. There is a huge oversupply and little demand. While there is a case to bring down the rentals, there is absolute no justification to increase the same. It is legitimate to increase the same on mutual agreement basis. But here is a owner who is a law unto himself and decides unilaterally what rental increase should be. Worse than that, he deducts it and claims it despite there being no basis or agreement. And further, have we ever heard of anyone increasing rentals just for the notice period duration? Does this practice even exist as a convention?

Therefore avoid this or any of his other properties. He is not at all a fair man despite his position. There are far better choices in Hyderabad and law abiding owners. I understand that Mr.Durgesh Sharma also has a plan to sell the flat. If this is the way he treats those merely renting his premises, we can only imagine the torture in store for those wanting to buy his apartment.
