I am writing to file an official consumer complaint against Chandana Brothers Textiles and Jewellers Pvt Ltd – CMR Jewellers, KPHB branch for selling me a defective gold ornament and attempting to impose unjustified and illegal charges for its replacement.
1. Purchase Details:
Date of Purchase: March 30, 2025
Gold Scheme Accumulated: 23.275 grams
Ornament Purchased: 63.057 grams (Net Weight)
Additional Weight: 39.782 grams (on which 12% wastage was charged)
Total Bill Paid: ₹5, 60, 000 (includes GST, stone charges)
Gold Rate: ₹8, 360 per gram on purchase day

2. Issue Faced:
On April 5, I noticed a manufacturing defect in the purchased item.
The store declined to exchange it due to partial gold scheme usage, and assured me of repair by April 10. They didn't provide an update on the repair status over call till April 17 and finally I visited the store on April 18 and asked them about status and they asked to give some more time.
After multiple visits and no updates, the store finally admitted on April 21 that the item could not be repaired.
I selected a replacement item (71 grams), but the store insisted I pay GST and stone charges again on the full amount, instead of adjusting by weight or refunding only the difference. For which I denied and asked them to replace the exact item within the same weight by making it but for that also they asked me to pay additional stone cost and GST.
3. My Concerns:
I am being forced to pay double GST and stone charges again for a replacement of a defective product, which is not my fault.
They are refunding only the invoice value (₹5, 60, 000), not the gold weight, even though gold prices have now risen to ₹9, 290/gm – causing a financial loss and reduced gold return.
The store refused to replace the item with the same model/weight or remake it as per the original.
GST should be charged only once on the supply. Reapplying GST on a defective item's replacement is double taxation, which is illegal. a defect not caused by me is an unfair trade practice.
5. Relief Sought:
Free replacement of the defective ornament without any new GST or stone cost.
If a different item is offered, adjustment based on weight, not value.
Compensation for the delay, mental distress, and potential loss due to increase in gold price.
Strict action against the jeweller for unethical trade practices.
