Sir,

This is to inform you that we around 1600 people booked our dream flat in pre launch of affordable housing project named clan city (Formerly known as hexcity) in kharghar in 2010 @ basic cost of 26.5 lacs. During booking it was committed by builder to deliver the project in 2014 but builder used our interest free money for almost three years and started the work in 2013. Also in 2013 he prepared one sided agreement which is completely in his favour and levied the other charges cost of around 16.5 lacs (6 lacs for parking in cash, 5.45 lacs for development charges,, 2.5 lacs for society charges & 2.5 lacs for club house membership charges) and we buyer had no other option to sign it to register our flat. Hence the 26.5 lacs of affordable home finally cost us at 48 lacs including other cost, stamp duty, registration and 2 yrs advance maintenance charges. Now as on date we have paid 88% amount as per the agreed payment schedule and all of sudden builder is demanding an escalation cost of 8, 44, 000 rs which is completely unrealistic. When asked about this demand he is giving reference of some clauses of the one sided agreement supported with delay in acquiring project approvals and rise in construction materials cost which has nothing to do with buyers.

We are waiting for our dream homes since last more than 6 yrs and most o[censored]s are shelling out huge amount against rents.In actual builder has to compensate for the rents but in turn he us demanding escalation cost. We are already in loss booking in this project and are very much frustrated with such unrealistic demand from builder. We really seek your support to withdraw the escalation demand from builder and to get our long awaited dream homes.

One sided contracts are not legitimate as per supreme court guidelines in DLF case (You can search it on google). As per the new real estate act RERA 2016, the builder cannot ask for money at his will. Such hike is unreasonable and mounts to cheating. Since, you have signed the agreement, the builder is pushing for the clauses. But no one can go against supreme court guidelines. Also, you mentioned about Parking. As per SC guideline in 2010, the builder has no right to sell the parking space separately as it is part of common amenities. Only the Housing Society can allot parking as per the guidelines. Even if you buy a parking space, anyone else can file a complaint and get the allotments cancelled. They money paid to the builder is illegal. This will not stand in court for even 10mins as Supreme Court guidelines are extremely clear with respect to parking space.

I got a flat in RUBY and I also got a cost escalation demand of 5.58 lacs from the builder as it is a 1 BHK flat. I never knew what to do here, builder (Supreme Constructions) sent me a supplementary agreement copy with a reduced amount of 4.65 lacs to cover the agreement charges in case of re-registration.

I sent the supplementary agreement copy to the Bank as advised by the builder and the bank legal team Mumbai said that no other customer has approached the bank yet for escalated cost and they want to talk to the builder. May I request you to contact me on the below email or phone number, I just ant to know what you or other customers are doing for this. Since I have shifted to Delhi, I am not in a position to visit the builder to find other contacts.

Booking of Clan City(Hex-city) project was started in year 2009, with a promise that they will make a home for us at a total cost of Rs. 26.5 Lacs(which include 1.299 lacs of other charges) [Ref: Hex-city application booklet] with a promise to give possession in year 2014. Don't be surprised this was the rate of a flat at this location at that time of year 2009. We were waiting for our dream home investing our hard earned money.

Agreement was executed in year 2013 with increased cost. Unnecessary, they increased the cost for us as well(booked the flat in year 2009) with following components which nobody can believe:

Common Infrastructure Charges- Rs.1, 19, 000/-

Amenity Space for public services- Rs.1, 04, 720/-

Development Charges - Rs.1, 19, 000/-

Water Resources Charges - Rs.1, 19, 000/-

Light/Power Resource Charges- Rs.61, 880/-

share money, application charges-Rs.38, 080/-

One time maintenance charges - Rs.2, 50, 000/-

car parking space- Rs. 5, 00, 000/-(in black)

Therefore, an extra cost of Rs.13, 11, 600 was asked, which was not at all mentioned at the time of booking. Nobody can believe that development charges can framed with so many components. When asked for explanation there reply was to quit if we dont like. Four years after booking they were asking us to quit. We made a group at that time and hire a lawyer, paid the fees to him which we collected in a group. But, alas, as it happened in India, the lawyer was hijacked by the builder and some of our leader in the group. Then we didn't have any option rather than going for an agreement at this rate.

Further, the same attitude don't stop here. Again they open their mouth for another price escalation charges of Rs.8, 44, 000/-. To which, even after requesting multiple times they could not provide us the basis and references by which the said figures had been arrived at.

When we go and meet them, we get threat and saying that if we dont pay these uncalled charges they can further add on such other charges on us and we will not have any option other than paying these charges as possession will be at stack.

If we are middle class and peace loving person. If we dont wanna 'chakkar of court' . than what to do.

This is real height modern day decoity.

I have also received demand for extra charges for CLAN City. Have you done anything further regarding this unreasonable demand of the Developer ? From 1 May 2017 RERA (Real Estate Regulatory Authority) has been started in Maharshtra. Every builder is required to Register their projects within 3 Months with RERA. RERA will have a website on which details of all the projects of all the builders have to be uploaded. We should form a group and file complaint against the CLAN group in RERA.

Hi Guys, there is Clan City association already set up by buyers, There are 102 buyers in the association. Those who do not know, As per Builder is now giving procession for first 3 building on 31 dec 2017 rest of the building procession date is not yet decided.

Only first 3 building work is going on rest building works has been stopped.

I would recommend you to join the association to get the latest updates.

Exactly Same thing happened with us. I paid the full amount of our 2 bhk flat in turquoise building. Now before registration they are demanding Rs.8Lac. We booked our flat in 2010 at Rs.26.5L and development charges and service tax extra.

Let's plan to involve media in this and take the media directly to the director of this project for exploiting people. First they are late by almost 3 year and now they are demanding escalation charges in name of that. Had it been completed 3 years before, nothing of this sort might have happenned. Nothing of this sort is mentioned in contract, It's exploitation.
United we stand, divided we fall.
Let's not give to the builder's demand and let him drag to media and let's see what he has to say in front of everyone.
Now they are targetting individually and exploiting.
Present status of Clan city

The possession date mentioned in the registered document has passed. But no communication from the builder about it. The work is going very slow. Builder has mentioned year 2022 as possession date in RERA. Is there any meaning of date mentioned in the registered document?
Any updates abt possession date i kept getting calls for exclation amt ..i hv a flat in ruby..in rera they hv mention 2022 dont kne wht they r planning...i hv been to the site inside work has started

I also have flat in Ruby Tower. I talked to Rep of developer two days back, who told me that inside work in Tower 4 has started. Nice to get it confirmed from you. For Ruby Tower they are giving completion date of Dec 2019. For whole project completion date is 2022. Individually buyer can complain to RERA for delay in handing over of flats and demand penalty.
Bought a house here a year ago. It started gradually but now moving fast. Seems like I can finally moving quickly. It’s a lovely area to live in. Good quality of construction. Thanks clan city!!!
