[Resolved]  C'est la Vie, 164, Hill Road, Bandra, Mumbai 400050 — Club Membership

Mr. Anthony Pereira (my husband) and myself had become members of the Bay City Club, Bandra in the year 2003. Membership No. 01 114601/02. The membership fees were Rs.90, 000/- with a provision that after 10 years, we could get refund of our security deposit of Rs.75, 000/-(after deducting administration charges of Rs.15, 000/-) if we did not wish to continue. We hardly used the facilities of the club for may be a year after which due to some problem the club got closed. The club has changed hands since then and is now taken over by C'est la Vie. Their phone no. is 26422361/62.

I now understand the club is taking new members. I have been in constant touch with C'est la Vie and spoken to various executives about my membership - whether we could continue to use the club facilities or get our refund back. The person I am now corresponding with is Mr.Girish Sippy (Cell No.[protected]). However, till date I am moving in circles and I am not getting a proper response from them.

Could you please help me in getting my refund? I have all original documents from Bay City Club which can be produced if required. This is my hard earned money and your help would be highly appreciated.

Thank you.

MUMBAI: A group of 20 members who have been denied access to an elite health and lifestyle club in Bandra for almost a decade can finally heave a sigh of relief. The state consumer disputes redressal commission has directed the club to provide them access to its facilities or return their membership fees.
"Not providing access of club facilities to its members is a deficiency in service, " the commission said. It also ordered the club to grant them immediate and regular access or else, if desired by the members, pay them Rs 10 lakh along with 12% interest since December 2004 and Rs 1 lakh as compensation.
The commission on Tuesday put an end to a battle that began in 2005 between members of Mahim's Bay City welfare society and C'est la Vie, a club located at Hill Road, Bandra. The society said its 20 members who had each paid Rs 50, 000 deposits to become members of the private club. The members said they were denied usage of the club facilities in 2005 based on a court order. The club's title and rights were reportedly transferred by Bay City Resorts to Shaila Clubs and Resorts Pvt Ltd through an auction.
