Realignment of proposed 100 Meter (UER-II) Urban Extension Road-II, passing through M & N Rohini Sub City Zone (North-West Delhi)
We the Member of Bhagya Vihar Residents Welfare Association (Bhagya Vihar Jain Colony, Rani Khera, Delhi-81) are submitting the objection stated hereinafter in response to your DDA advertisements dated 07.01.2008, this date was extended up to 8th April, 2008.On 03.10.2007 the Delhi Development Authority prepared the draft Zonal Development Plan of (Zone M & N Rohini Sub City) North-West Delhi-II enclosing herewith a plan of Zone M as per the Zonal Plan, A 100 Meter Urban Extension Road-II (UER-II) with 40 Meter. wide green belt on both the side is shown in the plan connecting State Highway No. 8 and 10 with National Highway No. 1.
The layout of Zonal Plan M & N is Annexed to the representation objection as Annexure P/1. Unfortunately the alignment of the proposed in Zone-M & N is passing through Bhagya Vihar Jain Colony which are approved for regularization. We appreciate that an Urban Extension Road is a Public Facility and has to be implemented as a mater of Public Interest and policy. But if the present alignments is maintained about 3000 thousand of families would be affected and lose their shelter. The only alternative to save these families who belong mostly to the lower Income groups from loss of their shelter is to realign the Urban Extension Road-II (UER-II) as shown in the realigned plan of the 100 meter wide Urban Extension Road-II, the plan showing the realignments of the Urban Extension Road (UER-II) is Annexure P/2.
We attended the public hearing on 28/08/2008 at 2:30 P.M. at DDA Vikas Sadan INA Market, Delhi-110023 undersigned submitted this petition along with all enclosures in person.
The colonies mentioned above are included in the list of 1432 colonies our Serial No. is 439 & 1430, we also receive Eligibility Slip for Issuance of Provisional Regularization Certificate on dated 11th August, 2008, We also received a Provisional Regularization Certificate on 4th October, 2008 by the Government of NCT of Delhi
2. The Hon’ble High Court of India in Writ Petition No. 11541/05 passed an order on 20.03.2006 directing that the petitioners would file a representation under Section 48 of the LA Act 1894 for de-notifications since of the land under the occupation of the members of the respective association and make a representation to the Lt. Governor, Delhi for disposal of the representation within three months and status-quo should be maintained till the expiry of on month from 20.03.2006. The interim injection against demolition was passed on 19th September, 2005.
The Welfare Association mentioned above have already submitted to the written representation to the Lt. Government, Delhi on 29.04.2006, but no date has been fixed for hearing.
3. The proposed Urban Extension Road (UER-II) as per Annexure P/1 will cross the New Rohtak Road (State Highway No. 10) just to the North of Village Mundka and will pass through the Residential Colony of Bhagya Vihar Jain Colony, Rani Khera, Delhi-81.
The realignment of the road as suggested in Annexure P/2 will not affect any existing Residential Area, but will save more than 3000 thousand families from uprooting. The Government / P.W.D in numerous cases changes the alignment of the road in the public interest. Particularly to avoid demolition.
However, it is clarified that because of realignment of the Urban Extension Road-II (UER-II) as per Annexure P/2, the overall length of the Urban Extension Road-II which will bypass the colonies mentioned above shall increase about K.M. and the alignment and the High Tension Overhead Cable shall have to shifted about 2.25 K.M. (Curve Distance 1.4 K.M) from the alignments shown in Annexure P/1.
We sincerely and fervently hope and pray that the Authority shall strike a balance to resolve the difficulties faced more than 3000 thousand families by the realignments the Urban Extension Road-II (UER-II) and if any cooperation in this regard, is required o[censored]s, we shall be ready and willing to cooperate to save ourselves and our next generation from coming back on the road.

We are residents of Mansarover Garden near Hotel Jageer Palace, C-6/1, Mansarovar Garden.Ring Road, New Delhi. We are facing a very big problem of noice pollution due to the generators voice in the back side of the hotel. There are many suspected drunken people are also stayed in the unauthorised room constructed by the hotel in the back lane of the hotel. Suggest if there is any rule to remove them from the back lane of the hotel jageer palace. There is no action taken by the govt. authorities after sevral complaints. all the officers are taking huge bribe from the owner of the hotel. All the illegal activities like prostitution, gamblling are going on in this hotel jageer palace.
my self vishal and im live in ramesh nagar 2 block this is residential but i seen from long time this area used for commercial activity .The owner of 2/54 have lots of commercial vehicle and all the vehicle are standing in this residential area. some time i think that im paying house tax for residential area or commercial area .These people are used all area for commercial activity .all people are facing lots of problem due to these commercial vehicle.Lots of vehicle are enter in area in this area mid night 1:00 clock to 5:00 clock .There is no space for pvt vehicle parking .I think this place future of delhi if you are not take action any in this matter.

Further please refer our correspondence dated 28.08.2008 ( Annexure-2). We have number of correspondences to different authorities repeatedly. Annexure-2 was filled against the proposed road vide news publication/ notification dated 07.01.2008 (Annexure-3). Accordingly the residents of Bhagya Vihar having public hearing in the presence of DDA Chairman, Sh. Mahabal Mishra & other dignitaries. (Annexure-4 Ref. No. F.4(15)/2007/MP dated 13.08.2008).
Hon’ble Sh. Mahabal Mishra assured us the discission/ order will be in favor of our colony resident’s interest. So far we have not received anything in writing about the promised favorable discission by Sh. Mahabal Mishra and Members of the Committee.
Thereafter, we have file a written petition to Hon’ble Chief Minister of Delhi, Smt. Sheila Dixit reference no BVRWA/0011 dated 28.05.2010 (Annexure-5). Hon’ble Chief Minister directed the DDA for necessary redressel. Accordingly Principal Secretary, Urban Development wrote to Vice-Chairman, DDA for favorable redressel ref. no. 439/1430/UC/UD/2010/735-737 dated 09.06.2010 (Annexure-6).
A letter was written to Minister o[censored]rban Development dated 14.11.2009 (reference point-4) Copy to following authority:-
1. Sh. P.K.Tripathi, Pr. Secretary to the Hon’ble Chief Minister
2. Secretary ( Land & Building) Vikas Bhawan ( Annexure-7).
Further a letter was written for the above purpose dated 10.02.2010 ( Annexure-1). It is to emphasis here that:-
1. Bhagya Vihar, Jain Colony is one of the 1432 unauthorized colonies approved for regularization by the Government of India on the recommendations of the Government of NCT of Delhi. Most of the residents of this colony have been living here for more than 20 years and belong to lower strata of this society.
2. The Government of NCT of Delhi issued a provisional regularization certificate to our colony bearing No. F.1-33/UC/UD/2004/Pt.III dated 17/09/2008. ( Annexure-8)
3. Our colony appears in 733 list of colonies finally eligible for regularizations.
4. Ignoring the fact that it would render thousands of residents homeless, the DDA has proposed construction of a 100 mtr. wide Urban Extension Road-II alignment of which is going to badly affect about 500 houses under the provisionally approved layout plan of the colony. To save thousands of family from loss of their shelter, suggestion was given to the DDA to realign the road partially and detailed realignment plan was also submitted. The DDA, in the meeting of the Board of Enquiry held on 28th August, 2008( Annexure-4), appreciated our suggestion and assured that it would be examined further carefully. However, the outcome of our objection / suggestion is still not known.
Unfortunately DDA without consulting the residents /RWA and ignoring the principle of Bhagidari has proposed a 100 Mtr. wide urban extension road connecting National Highway No. 10 and the alignment of the road is going to affect about 500 residential houses which are in the provisionally in the approved layout plan of the colony. To avoid rendering large number of families again shelterless, an alternative alignment of the proposed 100 mtr. wide road was submitted by the residential colony to Sh. B.M.Bansal Pr.Commissioner - Cum-Secretary, DDA on 13.08.2008.(Annexure-4 Ref. No. F.4(15)/2007/MP dated 13.08.2008).
In view of the facts submitted above, we sincerely and fervently seek your urgent intervention in the matter, You are humbly requested to direct the authorities concerned like DDA and Urban Development Department to realignment the road and laying of water pipe lines to save more than 2500 families from uprooting and also to declare our colony formally regularized at the earliest, realignment of the proposed 100 Mtr- UER-II Road ( Urban Extension Road-II).
Once again your good self is requested to reconsider our requested subject matter to avoid mass demolition and loss of habitation/ livelihood.

Esteemed Sir,
It has been observed several times, a person has got road accident but no one becomes ready to help the needy person in front of the public on humanitarian ground in Delhi. There are several reasons for non cooperation of the public either to injured nor to the police.
I would like to submit a request for necessary ‘Precautionary Measures’ for a person get injured and eyewitnesses during road accident in Delhi which resulted in NO BODY COME TO HELP the injured due to harassment to the helper by Police Department, is as under for your kind consideration:-
IX) That the local police starts interrogation of witnesses.
X) That the public eyewitness has to be indulged in the accident case, as it is time taking process.
XI) That the injured person shall be taken to the hospital for MC and witness has to wait until the I.O. has come.
XII) That the person doing offence responsible for the loss but eyewitness is being victamised.
XIII) That due to hectic life style in Metro City, no one is ready to give his time for others.
XIV) That the matter resulted in quarrel between the witness and offender..
XV) That thousands of such cases are pending in the Courts of Delhi.
XVI) That the concept may be discussed at large.
In view of the situation explained above, it may be comprehensive step of the Govt. of NCT of Delhi to provide the most required facility to the public without any harassment by Police. You are, therefore, requested to kindly do the needful to the thousands of family in your constituency.

I would like to submit a request for issue of necessary GUIDELINES for buyers of private property in Delhi due to forgery/harassment to the public by builders/vendors/property dealers at the time of Registration of the Sale Deed in Delhi. The facts are as under for your kind consideration and further transmission to all the Registrars/Sub Registrars in Govt. of NCT of Delhi :-
i) That it has come to notice some Vendors/Seller/Property Dealers sale the private property to a person without receiving/producing NOC from the Building Department of MCD.
ii) That it has come to my notice some Vendors/Property Dealers sale the property to a person without clearing their dues with discom i.e. NDPL/BSES of their pending electrical bills at the time of construction of the building.
iii) That there are Vendors/Property Dealers who sell their property to the Vendee/Buyer and do not get NOC in connection with the Property Tax from MCD.
iv) That they do not submit NOC from Delhi Jal Board in respect of their pending water billing at the time of construction of the building.
v) That Registrar Office does not ask the Vendor to produce all the above NOC’s at the time of registration of the SALE DEED.
vi) That the Vendee has to face several problems after taking possession of the property.
vii) That the Vendor/Seller never bother the complaints of the Vendee/Buyer after taking complete payment/registration of the Sale Deed.
viii) That the information submitted by Seller/Vendor about NOC from MCD, DJB, Discoms can also be mentioned in Part-II with deed related details before payment of stamp duty.
ix) That the matter resulted in quarrel between Vendee and Vendor.
x) That thousands of such cases are pending in the Courts of Delhi.
xi) That the concept may be discussed widely.
In view of the position explained above, it may be comprehensive step of the Govt. of NCT of Delhi to provide the most required facility to the buyer of private property in Delhi.
