Edelweiss Capital — Discrimination against tenants

I have a rented appartment in an appartment building in Mumbai. I just renewed my contract with the landlord for the second year. The problem is the society has just changed it rules on parking facilities. They are not allowing any tenants to park inside the compound walls. There are no assigned spaces allotted or sold in the compound.

Is the society allowed to discriminate against tenants like this?

Legally speaking, a tenant is entitled to enjoy every single right that the a member enjoys other than the right to vote in matters concerning the common interests of the society. Even these "common interests" can not violate the MCS Act.

Assuming that the landlord will be on your side, you need to start parking your vehicle inside the compound. The society, can not have one set of rules for the owner and another for the tenant. If they do, they are violating the law.

If the society responds by tinkering with your vehicle, you can file a police complaint against the watchman. If matters get worse and the secretary or other committee members harass you, you can file an FIR against the entire managing committee. You can also file a case of criminal intimidation against the committee members in court.

All of this is assuming that landlord remains on your side. If he/she chickens out and gives you a notice to vacate, you can't do much. But if the landlord is on your side, you can make the committee members piss in their pants.
