[Resolved]  Kalpataru Ltd. — MVAT

Even though the issue of MVAT on residential properties is under dispute and in courts, builder is asking us to place FD in a bank with a lien marked to him for the tax liability. Even though court has stayed the issue, is he within his rights to hold back the possession of the flat for the MVAT liability? He alos refuses to provide anything in writing for the said issue.

Dear Complainant,

Please confirm is your matter related to a redevelopment project or a new project.

i just need to understand that if the builder is doing is drama for selling his own property then original owners of redeveloped property are in safe hands. This also shows that the builder has good finance & doesn't care much to sell his property, any how.. I trust you understand what I mean.. Best Luck .. !!!

This is a new project by Kalpataru Ltd. in Pimple Gurav, Pune. Before giving possession the builder is asking all the flat owners to deposite 4% of property value as FD in HDFC Bank. The FD will remain in the name of owner but power of execution will lie with Kalpataru Ltd.

Most of the other builders are either taking post dated cheques or issues a Bond to flat owners which alerts flat owners to pay respective MVAT in case case pending in courts is won by Govt. of Maharashtra. The Kalpataru flat owners have to unncessarily block INR 1 Lakh to INR 1.5 Lakh in the name of MVAT.

Not to mention that Kalpataru Ltd. has already delayed the possession of flats by margin of 8 months to 1 year.
same is my scenario in mumbai. thane flat.they are just playing with us. they have no sense about customer service. i feel pitty for them.
who is the owner of kalpatru?
