3 Details of Complaint :The complaint booked a flat bearing no. B3/706 in one of the upcoming projects of the certified company named as "Tulip Grand" in Kundli, Sonepat, Haryana on 12.02.2007 which was promised to be delivered in 3 years of booking
a. The company not only has failed to deliver possession in time but has failed to obtain the completion certificate from the Authorities and is forcing possession on the applicants. This is totally against the law of the land.
b. The company has arbitrarily asking for the interest @ 2% per month on the amount alleged to be due to the Company which has never been due since the company is yet to obtain the requisite clearances/certificates from the Govt. Authoritities
c The company is now resorting to extortions and threatens to show its muscle power through some goondas/antisocial elements.
d The Company has now informed us that it has forfeited our hard earned money- an evident case of cheating and breach of trust.
4 Chronology of Events The complainant has paid a sum of Rs. 15.00 lacs during the period starting from Feb. 2007 but stopped paying further because
a. the company has used inferior material in constructions. The quality of construction is very poor and not upto the mark and also not as promised in brochures/agreed upon. The sample flat has been destroyed with malafide intentions so that its commissions and omissions towards cheating us and the other applicants could not be matched/pointed out.
b The Company could not complete the project so far
5 Correspondence The complainant has been taking up the matter with the Company incessantly but for no positive outcome.

As concern of you complaint that is totally wrong you are blaming on company reputation we have successfully delivered this project around more than 200 registry have been done and further this process is continue.
you are blaming project is not completed around more tan 90 families is living there and there is not a single complaint from them. our all kind of amenities is also operational like( pool, club, gymnasium, etc)
so its my humble request to you dont put these kind of comments about company reputation .

Complaint is extremely valid, we have faced similar extortion, and breach of trust by the Builder and prayer is next to Hon'ble Justice of India.


The builder has not only exposed poor quality of services but has shown Goondaraj too. The builder is well experienced in manipulative tactics and has a reputation to over power consumer rights.

Due to above pending issue;

We and our families are
not safe due to weak security deployed at our society. Outsider and local
people had intruded in our society thrice due to negligent and casual services
provided by existing service agency. The guards deployed are not competent from
any parameters. We had to file complaints with local police to keep them out of
our society.

·
It is almost more than
Eight months now when we occupied your society and since then there is no
permanent electricity connection for the residents though you have charged
Rs.150/- per Sq. Ft. at the time of giving passion. The society is running on
temporary electricity connection taken for construction, which is quiet often
fluctuating in a day resulting into damaging of our domestic appliances.
Further there is no automatic switchover from DG to the electricity line and
vice versa causing a lot of inconveniences to the residents.

STP plant has not been
made operational after even more than Eight months of occupancy in your society
resulting into contaminated or highly unhygienic waste is getting disbursed in
front of our society which is causing high degree of health hazard and
unhygienic life for people living in the society.

·
The drinking water
supply provided by you in our society is having very high TDS value which is
not in compliance with prescribed standards of drinking water, which is 500-700
TDS value. This issue is right from the beginning and we intimated you orally
as well as in writing. However, you have not provisioned anything for the
benefit of the residents. In our past meetings, on our suggestions you had
assured to install RO plant so that the water supply will be fit for drinking
to avoid adverse effect on our skin and stop hair fall.

In Oct’13, we have occupied
our flats/apartments and since then Apple Facility is facilitating operations
in our society and they don’t have adequate quantity of spares with them to run
services whereas Tulip/Apple had already taken Rs.2.50 per Sq. Ft. since day
one for 2 Years. Due to this our very small-small day-to-day problems are
getting delayed and can’t be fulfilled by them on same or next business day.
Also the service team deployed by Apple is of very poor quality and they don’t
have adequate qualifications and know how to rectify issues quickly and on
time. This is a case of extracting undue money from resident at an unreasonably
high rate and thereby not delivering the proportional and compensatory quality
services and falls within ambit of cheating & misrepresentation.
