Lifetime maintenance fee collected by Prestige Constructions (of Prestige Group) for plots sold at North West County (NWC) located along with Angsana Resort near Yelahanka, Bangalore, has not been properly accounted for and restored. A sum of Rs 1 lakh was collected for a 10,000 sqft plot at NWC as maintenance fee. This principal as well as the accrued interest collected for about 190 sites should currently (2012) be more than Rs.5.25 crores. But the Corpus Fund as reported by Prestige is only Rs. 1.5 crores i.e. more than Rs. 3.75 crores deficient. Prestige has not maintained proper accounts of the money collected resulting in this enormous loss to site owners. Prestige also does not reveal the date of sale of all the properties and the monies collected from them at NWC so that an accurate calculation of the Corpus Fund can be made.
Although I have personally made repeated requests over the years on this issue all the way to the Chairman Mr. Irfan Razack there is no response whatsoever from Prestige Constructions. They brusquely use their power to stonewall any inquiry into this matter.
What legal options does one have in this matter? Can this be brought to Consumer Court? Was this information helpful? |
