I, Yellapu Prasad, S/o Late Appa Rao my property Assessment No: 15064, bearing D.No:32-1-202, Bowdara Road Visakhapatnam.Ward No: 29. I had paid my property Tax for the year[protected] and the year[protected] of Rs.124847/- on 9th June, 2009 at saukaryam G.V.M.C but unfortunately they issued me a receipt No: 0469324 Challan No: 26095 stating as I paid in way of Cheques bearing No: 514118 of Rs.80541/- and cheque No: 514120 of Rs.62468/- dated.19th June, 2009.After observing this I was contact the bill collector Mr.Jaganadha Rao and the person Reddy in the Computer Section. They said it has been printed wrong and they said it will be Rectified by 2 or 3days from that day onwards they postponing the matter. After I met R.I (Revenue Inspector) Zone III .He said that he will verify the matter and later he also dragged, after serious conversation with R.I., he checked in the system and said that they are no Taxes due. Your payment as been accepted and rectified the above issue and he advised me to pay the latest Tax i.e.,[protected] first term tax and I paid the latest tax for[protected]st Quarter of Rs.15041/-wide receipt No: 0530749 dt.[protected] after paying 1st Quarter tax, the tax was updated by showing No dues of taxes till date I.e., 10th January, 2010.

After two months I got received a demand notice stating that I was due of my property tax of Rs.1, 86,472/- to be paid within a week of the notice, nor the property will be auctioned. So I consulted the R.I. and Bill collector Jaganadha Rao, but there was no reply Jaganadha Rao and Reddy were absconding for my pressure. Again I had paid tax of Rs.1, 01,948/- through Receipt No: 14031and 14033 Dated.[protected]. I sought Information under R.T.I. Act to the Asst commissioner Zone-III to furnish the cheque alleged to have been issued by me. I received information stating that the cheques were issued are belongs to one Mr. P.Rambabu Account No: [protected] SBH, suryabagh branch, Visakhapatnam. Then the in- charge commissioner, found the misuse of tax amount received in saukaryam and a complaint was given there upon the above named persons were arrested and recovered Rs.3.60 Crores.

While so I addressed a letter dt.[protected] to the Commissioner to adjust the excess tax amount paid by me to the corporation for the upcoming period tax or to refund the same, but no information was received by me ,while so I sent letter under R.T.I. Act to your Authority for giving copies of the cheques alleged to have been issued by me for taking necessary action, your office fails to furnish the same having no option I filed a complaint No.14358/SIC-CMR/2010,dt.[protected] as referred above before the A.P.Information Commission and the State Information Commissioner pleased to order your Authority through this order dated.[protected].

The complainant states that he could not go to the Court in time, since the bounced cheques were not supplied to him.Due to non supply of information the complainant was put much loss by paying tax twice. The Commissioner, GVMC to examine the above averments made by the appellant and resolve his problem within (30), since he could not seek legal remedy, as the copies of cheques not given by him were not supplied to him.

I submit that as per the orders of A.P. Information Commission the said order should be implemented within 30 days but your Authority fail to comply the same.

I, therefore request your kindself to adjust the amount paid in excess by me in pursuance of your Demand notice shall be returned or adjusted in future Tax period. If not I will be constrained to approach A.P. Information Commission for non-complicance of orders.
