Sub:Request for removal of debri (malwa) from road laying after demolition of illegalencroachmentat T-5 Upper Anand Parbat Industrial Area, Street No 10 New Delhi-110005 & Legal Action Against the encroacher.
Respected Sir,
I am running a export factory at T-5 Upper Anand Parbat, Street No 10, New Delhi-110005 from the last 15 years. There was illegal encroachment in front of my factory and on road from some time. In my absence the road/land was grabbed and illegally encroached by one person Shiv Parkash alongwith his brother and others. On 04.09.2010 Municipal Corporation of Delhi Karol Bagh Zone has demolished the said illegal encroachment.
The debri ( malwa ) is still lying on the road and the illegal encroacher named Shiv Parkash along with his brother is not removing the debris by excusing that it has his belonging and we are scared he might re-encroach on the road illegally and reconstruct it on the government land/ ROAD again.
“Since it is rainy season the rain water and kichad is accumulated in the debri which is also breading mosquitoes’ foul smell etc. There is a risk of spreading disease like Dengue, swine flu etc. and life of public; my workers and me are at great risk”
The debri lying there is also creating nuisance and hurdles to the Public as few passerby have got injured from debri and is also interfering my entrance and my business activity. I am not able to load or unload my goods as the debri has almost blocked my entrance. The debri lying on the main road of Street No 10 is also interfering in movement of traffic and causing traffic jam etc. Since the illegal encroachment is not fully removed it is also causing danger to my building and workers of my factory who might get injured while working there.
After the demolition On 04.09.2010 the encroacher Shiv Parkash and his brother along with some hired gundas gathered near malwa/debri and when request them to remove the debri they start pelting stones on my labours and my workers and on me. For our safety I made an emergency call to the police control room No 100 and the police came atthe spot and stopped theencroachers from doing anyillegal activity.
Again on 05.09.2010 around afternoon the same persons named above came to the site and start building brick wall on side of demolished area/ road which was also stopped by Police afterwe complaint to PCR . During the night they called upon about 50-60 hired gundas and all are hiding on some vehicles and in near by a tea stall on road side encroached by another person name TN and he is provoking others to grab the land again. The above named persons along with the gundas and bad elements areillegaly trying to grab the public land/road at the front of my factory.
In view of the above,It is also requested that strict action should be taken against these encroacher named Shiv Parkash his brother and other gundas and also refrain them from any encroachment activity on the road/public property so that they do not encroach the land again.
In addition to above I also request you to kindly make some arrangement to remove the debris and clear the road
Sir, as a good citizen and law abiding person it is my duty to inform you about the situation and hope you will take immediate action to remove above said debris/ malwa.
