[Resolved]  Shivam Parivar Developers Limited — Breach of Trust, Cheque Bouncing, Avoidance of Communication, Cheating

We had purchased a flat from Shivam Parivar Developers over 2 years back in their project Gulmohar CHS in Goregaon. Since the building construction was stuck for a long while and no work happened in 2 years we decided to sell the flat. However since there was an allotment done in our case, it was decided that our allotment will be cancelled and the builder will return the amount that we had given to them as the booking amount. The director - Mr. Sanjay Bhosale has given us 2 cheques and the same have bounced (HDFC Bank - Cheque No. 54608 - 5 lacs and 54609 - 9 lacs), and ever since they have been lying regarding the payment. It has been more than 3.5 months and until now the payment has not been returned. Also whenever we call the receptionist she does not transfer the line. We have shifted base to Bangalore and hence it is not possible to meet Mr. Bhosale on every occassion.We would like to put in a consumer complaint for breach of trust, cheating, lying to customers. We are also contemplating filing a suit under the Negotiable Instruments Act, for the cheque bouncing.

Certainly Understand the dissapointment which you are going through. I would suggest you to file a suit coz this builder is a cheat & will not pay you a penny. We have been passing through similar trauma since 2007. We have even terminated this builder for our redevelopment project. Have been hearing that they have sold their assets/liab to another Co. Kamla Group though not sure how true is this.

The Kamla group which has taken projects of shivam is into a mode of extortion of more money from customers who had booked their flat. Buyers beware. Both are cheats. People have been waiting for their flats for more than 10 years. One of the directors by name Piyush Kulshreshtha in kamla group is the forefront of this extortion. He has been threatening the customers.

In my opinion, and I am working on it, People who have been cheated By Shivam Parivar need to come together [ I have some who have already agreed] and file a complaint with the Economic Offences Wing at Worli. Though they may claim that they have friends there, if people come together, action against them is bound to be taken. We have suffered far too long and most sufferers are senior citizens with almost no source of income.
